10/22/2018 <br />RESOLUTION NO. 15709 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />SUMMARILY VACATING FOUR PUBLIC SERVICE EASEMENTS ON <br />COUNTY -OWNED PROPERTY DESIGNATED AS ASSESSOR'S <br />PARCEL NUMBERS 052-337-020 AND 052-341-240 IN THE CITY OF <br />REDWOOD CITY PURSUANT TO PART 3 OF DIVISION 9 OF THE <br />CALIFORNIA STREETS AND HIGHWAYS CODE; AUTHORIZING THE <br />CITY MANAGER TO ACCEPT A STORM DRAIN AND WATER LINE <br />EASEMENT DEED IN EXCHANGE THEREFOR; AND DIRECTING THE <br />CITY CLERK TO FILE THE RESOLUTION AND DEED FOR <br />RECORDATION <br />(COUNTY CENTER EASEMENT EXCHANGE) <br />WHEREAS, pursuant to California Streets and Highways Code Division 9, Part 3, <br />Chapter 4 (commencing at Section 8330), the City Council ("City Council") of the City of <br />Redwood City ("City") may summarily vacate a public service easement that has been <br />superseded by relocation, or determined to be excess by the easement holder, and there <br />are no other public facilities located within the easement; and <br />WHEREAS, the four public service easements to be vacated are described in <br />Exhibit A, Exhibit B, Exhibit C, and Exhibit D, attached hereto and incorporated herein by <br />reference; and <br />WHEREAS, the four public service easements are commonly known as "public <br />utility easements" with each meeting the definition of a public service easement pursuant <br />to California Streets and Highways Code Section 8306; and <br />WHEREAS, the County of San Mateo proposes to convey and City Council desires <br />to accept a Storm Drain and Water Line Easement deed, substantially in the form shown <br />in Exhibit E, attached hereto and incorporated herein by reference, receipt of said deed <br />being in exchange for those portions of the four public service easements that are <br />superseded by relocation or determined to be excess; and <br />WHEREAS, pursuant to Section 8333 of the California Streets and Highways <br />Code, the four public service easements have been superseded by relocation, or <br />determined to be excess, or both, and there are no other public facilities located within <br />the easements; and <br />ATTY/RESO.0095/CC RESO VACATING FOUR PUBLIC SERVICE EASEMENTS— COUNTY CENTER EASEMENT <br />EXCHANGE RESO.
