<br />6. <br /> <br />Abandonment. <br /> <br />In the event that Permittee abandons or fails to use the <br /> <br />City Right-of-Way, or shall fail, neglect, or refuse to maintain the aforesaid up-lighting <br />system and its appurtenances in a clean and good working condition, or to comply with <br /> <br />any of the conditions herein contained, or in the event that this permission shall be <br /> <br />revoked, then all rights of Permittee hereunder shall forthwith cease and terminate. <br /> <br />Permittee agrees to be solely responsible for all the costs associated with the safe <br /> <br />abandonment of the said up-lighting system and its appurtenances in the sidewalk. <br /> <br />7. <br /> <br />At the request of the City, Permittee shall realign or relocate the private <br /> <br />decorative up-lighting system at Permittee's expense, if said system interferes with any <br /> <br />City facilities the City may install in the future. Permittee shall relocate the private <br /> <br />decorative up-lighting system within sixty (60) days of a notice from the City to <br /> <br />Permittee, and delivered to the address above. <br /> <br />8. <br /> <br />Assignments. <br /> <br />The permit and the privileges granted to Permittee <br /> <br />hereunder shall not be assigned by Permittee without the prior permission of City. <br /> <br />Evidenced by motion of City's City Council, duly made and carried; provided, that no <br /> <br />such assignment shall be made which would allow or permit a use of the City Right-of- <br /> <br />Way different than Permittee's use thereof or for a private for-profit use. <br /> <br />9. <br /> <br />Successors. The terms and conditions hereof shall be binding upon, and <br /> <br />the benefits hereof shall accrue to, the successors in interest of Permittee, its assigns, <br /> <br />transferees, heirs, or grantees. <br /> <br />10. <br /> <br />Effective Date. This Permit becomes effective on the date of the last <br /> <br />signature ascribed hereto. <br /> <br />11 <br /> <br />Acceptance.
