D. Relative to the jurisdiction of the eCouncil, board or commission, no member thereof shall attempt to unduly influence or intervene in the City n1manager's, administrative officer's, or department director's exercise of supervision or control of any subordinate employee. 2. The foregoing shall not preclude any member of the eCouncil, or any board or commission from consulting with any eCity administrative officer or employee for informational purposes. 3. Any violation of the foregoing provisions of this section shall constitute a misdemeanor and shall work a forfeiture of the office of the offending member of the eCouncil, board or commission, who maybe removed therefrom by the eCouncil or by any court of competent jurisdiction. No persons related by blood or marriage to the eCity n3Manager, eCity officer or department director having appointment authority, shall be eligible for employment. CITY ENGINEER: City Engineer shall perform such duties as may be prescribed bylaw for a city engineer and shall also be sStreet &Superintendent, until such time as the eCouncil may direct a separate officer to act as sStreet sSuperintendent. The City Engineer shall be the custodian of, and responsible for, all maps, plans, profiles, field notes, and other records, and memoranda belonging to the eCity, pertaining to his er leer their office and the work thereof, all of which he or -she tligy shall keep in proper order and condition, with full indices thereof. The City Engineer shall turn the same over to hirer he their successor upon relinquishing hiser her their office, who shall give him or- he them duplicate receipts thereof, one of which he or she they shall file with the City Clerk. All maps, plans, profiles, field notes, estimates and other memoranda of surveys and other professional work made or done by him or her them or under his he their direction or control as City Engineer during hiser- h their term of office shall be the property of the eCity. The City Engineer shall, at the time of his erg their appointment, have been a practicing engineer for a period of at least three years. All other things being equal, an engineer who has had special training or experience in municipal engineering shall be appointed to this office, if practicable. The sStreet sSuperintendent shall perform such duties as may be prescribed now or hereafter, by ordinance or general laws of the sState. Nothing herein contained shall prevent the eCity mManager from acting as ex -officio City Engineer and &Street sSuperintendent and filling such offices as herein provided.
