and receive in accordance with all applicable laws, (ii) the construction, maintenance, repair, <br />operation, and replacement of its communications fixtures, related antennas, equipment, cables, <br />facilities and all improvements related thereto on the Premises, as further described in Exhibit <br />"B" (hereinafter collectively to be referred to as "Facilities"), and (iii) activities related to any of <br />the foregoing, provided such activities do not require an expansion of the Premises or Facilities <br />or violate Licensee's duties set forth herein, including, without limitation, the right to test, survey <br />the Premises and review title on the Property; the right but not the obligation to add, modify <br />and(or replace equipment in order to be in compliance with any current or future federal, state or <br />local mandated application, including, but not limited to, emergency 911 communication <br />services, at no additional cost to Licensor ("Permitted Use"). Notwithstanding the foregoing and <br />notwithstanding Licensee's exclusive lease of the Premises under the Existing Lease, Licensee <br />hereby acknowledges that prior to the Effective Date, Licensor has been using a portion of the <br />Building for the installation and operation of Licensor's equipment as generally depicted and <br />identified as "CABINET BY OTHERS" or "RACK BY OTHERS" in Exhibit `°B". Licensee <br />and Licensor hereby acknowledge and agree that Licensor or the County of San Mateo, <br />California ("County") shall have the right to continue to use such portions of the Building for <br />the continued operation of Licensor's or County's equipment subject to the terms and conditions <br />set forth in Section 5, Interference, below. <br />1.4 Licensee shall not use the Premises for any purpose not expressly permitted <br />hereunder. Licensee shall not (a) create, cause, maintain or permit any private or public nuisance <br />in, on or about the Premises or permit or suffer the Premises to be used for any unlawful purpose, <br />or (b) do or permit to be done anything in any manner which creates a private or public nuisance <br />to the occupants of neighboring property, or (c) interfere with or disturb in any way (1) the <br />operations of Licensor on the Property, including operation of Licensor's system or tank site, <br />radio communication system linked to telemetry controls at various tank and pumping facilities, <br />or (2) subject to the terms of Section 5 of this License, the use of the Property by other licensees. <br />1.5 Licensee shall, at Licensee's expense, keep and maintain the Premises in <br />reasonable condition and repair during the Tenn. Licensee shall be responsible for maintenance <br />of the Premises. <br />1.6 Licensee shall install and operate the Facilities in a good and workmanlike <br />manner that shall at all times be in compliance with all applicable federal, state and local laws, <br />rules and regulations (collectively, "Laws").
