and receive in accordance with all applicable laws, (ii) the construction, maintenance, repair, operation, and replacement of its communications fixtures, related antennas, equipment, cables, facilities and all improvements related thereto on the Premises, as further described in Exhibit "B" (hereinafter collectively to be referred to as "Facilities"), and (iii) activities related to any of the foregoing, provided such activities do not require an expansion of the Premises or Facilities or violate Licensee's duties set forth herein, including, without limitation, the right to test, survey the Premises and review title on the Property; the right but not the obligation to add, modify and(or replace equipment in order to be in compliance with any current or future federal, state or local mandated application, including, but not limited to, emergency 911 communication services, at no additional cost to Licensor ("Permitted Use"). Notwithstanding the foregoing and notwithstanding Licensee's exclusive lease of the Premises under the Existing Lease, Licensee hereby acknowledges that prior to the Effective Date, Licensor has been using a portion of the Building for the installation and operation of Licensor's equipment as generally depicted and identified as "CABINET BY OTHERS" or "RACK BY OTHERS" in Exhibit `°B". Licensee and Licensor hereby acknowledge and agree that Licensor or the County of San Mateo, California ("County") shall have the right to continue to use such portions of the Building for the continued operation of Licensor's or County's equipment subject to the terms and conditions set forth in Section 5, Interference, below. 1.4 Licensee shall not use the Premises for any purpose not expressly permitted hereunder. Licensee shall not (a) create, cause, maintain or permit any private or public nuisance in, on or about the Premises or permit or suffer the Premises to be used for any unlawful purpose, or (b) do or permit to be done anything in any manner which creates a private or public nuisance to the occupants of neighboring property, or (c) interfere with or disturb in any way (1) the operations of Licensor on the Property, including operation of Licensor's system or tank site, radio communication system linked to telemetry controls at various tank and pumping facilities, or (2) subject to the terms of Section 5 of this License, the use of the Property by other licensees. 1.5 Licensee shall, at Licensee's expense, keep and maintain the Premises in reasonable condition and repair during the Tenn. Licensee shall be responsible for maintenance of the Premises. 1.6 Licensee shall install and operate the Facilities in a good and workmanlike manner that shall at all times be in compliance with all applicable federal, state and local laws, rules and regulations (collectively, "Laws"). Licensor agrees to comply with all Laws relating to Licensor's ownership and use of the Property and any improvements on the Property, only to the extent necessary to provide to Licensee continued use of the Premises and all of the other rights expressly granted to Licensee hereunder. 1.7 Licensee shall not place any signs upon the Premises without the prior written consent of the Licensor, except as provided in Section 20.1.
