health, safety and general welfare of the City to adopt the ordinance below in order to <br />establish generally applicable standards for such facilities, systems, and installations <br />within the public rights-of-way; and <br />WHEREAS, the City Council finds that the lack of current standards and <br />regulations in the Municipal Code for wireless facilities in the public rights-of-way, the <br />substantial number of anticipated applications for wireless facilities in the public rights- <br />of-way, and the potential liabilities and negative consequences for noncompliance with <br />state and federal regulations (including, without limitation, automatic approvals) present <br />a current and immediate threat to public health, safety, and welfare; and <br />WHEREAS, the public rights-of-way in Redwood City are uniquely valuable <br />public resources, closely linked with the City's residential and historic character and <br />natural beauty. While the reasonably regulated and orderly deployment of wireless <br />facilities in the public rights-of-way is desirable, unregulated or disorderly deployment <br />represents an ever-increasing and true threat to the health, welfare, and safety of the <br />community; and <br />WHEREAS, the regulations of wireless installations in the public rights-of-way <br />are necessary to protect and preserve community aesthetics, as well as the values of <br />properties within the City, and to ensure that all wireless facilities are installed using the <br />least intrusive means possible; and <br />WHEREAS, pursuant to Federal Communications Commission regulations, the <br />City cannot adopt a moratorium ordinance to toll the time period for review, even when <br />needed to maintain the status quo while the City reviews and revises its policies for <br />compliance with changes in state or federal law; and <br />WHEREAS, this ordinance is adopted as an urgency ordinance pursuant to <br />California Government Code section 36937(b), which allows the City to preserve public <br />peace, health, or safety. With a four-fifths vote of the City Council the urgency <br />ordinance will become effective immediately. Given the increased interest in <br />construction of small-cell facilities in public rights-of-way, it is critical that the City <br />update its regulations to reflect current federal and state law and recent trends in <br />wireless facilities. The adoption of urgency standards will ensure that the City is able to <br />limit disruption to the public rights-of-way as well as impose aesthetic regulations on <br />new facilities; and <br />WHEREAS, The City Council finds and declares that the immediate <br />implementation of the ordinance is necessary to preserve and protect public health, <br />safety, and welfare. <br />NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY DOES <br />ORDAIN AS FOLLOWS: <br />ATTY/ORD.475/RC WIRELESS RIGHT OF WAY ORDINANCE <br />REV: 12-12-18 VR <br />Page 2 of 4 <br />ORDINANCE NO. 2453. <br />MUFF NO. 305 <br />
