6.D. - Page 22 of 170 <br />Request for Qualifications: <br />General Park Building Construction, Retrofit, Maintenance, and/or Repairs <br />For the CEC forms, please refer to the Table of Contents and under "Forms and Attachments", click on the links to the CEC <br />forms; the appropriate forms must be submitted with the Response. <br />EQUAL BENEFITS ORDINANCE AND FORMS <br />Respondents are advised that any contract awarded pursuant to this procurement process shall be subject to the applicable <br />provisions of Los Angeles Administrative Code Section 10.8.2.1, Equal Benefits Ordinance (EBO). <br />All Bidders/Responders/Proposl shall complete and upload the Equal Benefits Ordinance Affidavit (two (2) pages) available <br />on the City of Los Angeles' Business Assistance Virtual Network (BAVN) residing at www.labavn.org prior to award of a <br />City contract, the value of which exceeds Five Thousand Dollars ($5,000.00). The Equal Benefits Ordinance Affidavit shall <br />be effective for a period of twelve (12) months from the date it is first uploaded onto the City's BAVN. <br />Bidders/Responders/Respondents do not need to submit supporting documentation with their bids, responses or Responses. <br />However, the City may request supporting documentation to verify that the benefits are provided equally as specified on <br />the Equal Benefits Ordinance Affidavit. <br />Please refer to the Equal Benefits Ordinance for information regarding the City's requirements. <br />Bidders/Responders/Respondents seeking additional information regarding the requirements of the Equal Benefits <br />Ordinance may visit the Bureau of Contract Administration's web site at http://bca.lacibL.org. <br />PROTEST PROCEDURES <br />The purpose of these procedures is to provide a method for resolving, prior to award, protests regarding the award of <br />contracts by the City, by and through its Board of Recreation and Park Commissioners. These procedures are for the benefit <br />of the City and are not intended to establish an administrative requirement that must be exhausted by the protesting <br />Respondent prior to pursuing any legal remedy which may be available. For this reason, no Respondent shall have any right <br />to due process, should the City fail to follow these procedures for any reason within its discretion. However, failure by a <br />Respondent to follow the protest procedures as discussed below will create the presumption that any subsequent legal action <br />in a court of competent jurisdiction is of no merit. These procedures will enable the Board of Recreation and Park <br />Commissioners to ascertain all of the facts necessary to make an informed decision regarding the award of the contract. <br />It is the policy of the Board that: <br />1. Officially signed and dated protests be received prior to the Board's award of any contract in response to this <br />RFQ. <br />2. Figueroa St., Suite 300 <br />Los Angeles, California 90012 <br />OR <br />Advance, officially signed and dated, copies of protests will be accepted via fax within the protest period to the <br />Board Secretary, Board of Recreation and Park Commissioners at (213) 202-2610. If faxing a protest, please <br />notify the Board Office at (213) 202-2640 prior to transmission. <br />3.
