6.D. - Page 49 of 170 <br />Request for Qualifications: <br />General Park Building Construction, Retrofit, Maintenance, and/or Repairs <br />ARTICLE 33 <br />CONFLICT OF INTEREST <br />The CITY may cancel any contract or agreement, without penalty or obligation, if any person significantly involved in <br />initiating, negotiating, securing, drafting or creating and contract on behalf of the CITY's departments or agencies is, at any <br />time while the contract or any extension of the contract is in effect, an employee of any other party of the contract with <br />respect to the subject matter of the contract. The cancellation shall be effective when written notice from the CITY is <br />received by all parties to contract, unless the notice specifies a later time. <br />ARTICLE 34 <br />CLEAN AIR/CLEAN WATER <br />The CONTRACTOR shall comply with all applicable standards, orders, or requirements issued under section 306 of the <br />Clean Air Act (42 USC 1857 (h) section 508 of the Clean Water Act (33 USC 1368), Executive Order 11738 and <br />Environmental Protection Agency regulations (40 CFR Part 15). <br />ARTICLE 35 <br />ORDER OF PRECEDENCE <br />In the event of contradicting requirements, the following order of precedence shall apply in descending order: <br />• Addenda, change orders, supplemental instructions and approved contract revisions <br />• The Contract Specifications <br />• General Standard Specifications for Public Works Constructions <br />• CONTRACTOR's bid <br />• Referenced Specification <br />• Federal and State Requirements <br />ARTICLE 36 <br />SAFETY REQUIREMENTS <br />Contractor will be responsible for all safety requirements and certifications in accordance with CAL -OSHA rules and <br />regulations. It will be the Contractor's responsibility to assess the work location and implement safety controls and <br />procedures that are compliant with Title 8 of the California Code of Regulations. All projects will be awarded to Contractor <br />as a "Single Employer" in accordance with CAL -OSHA classifications. Contractor will be responsible and have full control <br />over all construction activities as well as safety requirements thereof, for each as -need project awarded. <br />ARTICLE 37 <br />ENTIRE CONTRACT <br />This Contract contains all of the Contracts, representations and understanding of the parities hereto and supersedes and/or <br />incorporates any previous understandings, bids, commitments or Contracts, whether oral or written, and may be modified <br />or amended only as herein before provided. <br />IMPORTANT — RESPONDERS MUST SUBMIT ALL REQUIRED FORMS (COMPLETELY FILLED OUT) BY RFQ <br />SUBMITTAL DEADLINE. <br />Page 43 of 103 <br />132 <br />
