6.D. - Page 129 of 170 <br />CONTRACT BETWEEN <br />THE CITY OF LOS ANGELES <br />AND <br />THE PUBLIC RESTROOM COMPANY <br />FOR GENERAL PARK BUILDING CONSTRUCTION <br />CONTRACT # 3603 <br />This CONTRACT is made and entered into this 23Y day of 14pr,') 20 I �, by and <br />between the CITY OF LOS ANGELES, a municipal corporation, acting by and through its <br />BOARD OF RECREATION AND PARK COMMISSIONERS (hereinafter referred to as "CITY"), <br />and THE PUBLIC RESTROOM COMPANY, (hereinafter referred to as "CONTRACTOR"). <br />CITY and CONTRACTOR shall be referred to hereinafter collectively as "the PARTIES". <br />RECITALS <br />WHEREAS, the Department of Recreation and Parks of the City of Los Angeles (hereinafter <br />referred to as "DEPARTMENT") owns various facilities and infrastructure throughout the City of <br />Los Angeles and is responsible for the general park building construction services for park <br />facilities and infrastructure; and <br />WHEREAS, DEPARTMENT requires the services of an experienced and responsible contractor <br />to perform general park building construction services at various park facilities; and <br />WHEREAS, on April 6, 2016, the Board of Recreation and Park Commissioners (referred to <br />hereinafter as "BOARD") approved the release of a Request for Qualifications ("RFQ") for <br />General Park Building Construction (Report No. 16-087); and <br />WHEREAS, the RFQ was released on April 11, 2016, and nine (9) responses to the RFQ were <br />received on June 21, 2016; and <br />WHEREAS, five (5) of the nine (9) RFQ responses met the minimum requirements for the <br />general park building construction as specified on the RFQ and CONTRACTOR'S response <br />was one of the responses meeting such minimum requirements; and <br />WHEREAS, DEPARTMENT requires the services of CONTRACTOR to provide as -needed pre- <br />fabricated buildings (new park building structures); and <br />WHEREAS, CONTRACTOR has the necessary equipment and staff, possesses sufficient <br />knowledge, expertise, and experience and is willing and able to provide the services requested <br />by DEPARTMENT; and <br />WHEREAS, the BOARD, as the contract awarding authority, finds pursuant to Charter Section <br />371(e)(2), that the services to be provided are professional and special services of a temporary <br />and occasional character for which competitive bidding is not practicable or advantageous as it <br />is necessary for the DEPARTMENT to be able to call on contractors to perform this work as - <br />212 <br />
