6.G. - Page 76 of 238 <br />Adjustments to the wholesale rates will be adopted by the Commission at <br />a regularly scheduled meeting or at special meeting, properly noticed, called for the purpose of <br />adjusting rates or for taking any other action under the jurisdiction of the Commission. <br />2. The SFPUC will send a written notice by mail or electronic means to each <br />Wholesale Customer and to BAWSCA of the recommended adjustment at least thirty (30) days <br />prior to the date of the meeting at which the Commission will consider the proposed adjustment. <br />The notice will include the date, time and place of the Commission meeting. <br />3. The SFPUC shall prepare and provide to each Wholesale Customer and <br />to BAWSCA the following materials: (a) a table illustrating how the increase or decrease in the <br />Wholesale Revenue Requirement and wholesale rates were calculated, substantially in the form <br />of Attachment N-1, (b) a schedule showing the projected expenses included in the Wholesale <br />Revenue Requirement for the fiscal year for which the rates are being proposed, and supporting <br />materials, substantially in the form of Attachment N-2, and (c) a schedule showing projected <br />water sales, Wholesale Revenue Requirements and wholesale rates for the fiscal year for which <br />rates are being set and the following four years, substantially in the form of Attachment N-3. <br />These materials will be included with the notification required by Section 6.03.A.2. <br />4. Rate adjustments will be effective no sooner than thirty (30) days after <br />adoption of the wholesale rate by the Commission. <br />5. San Francisco will use its best efforts to provide the Wholesale <br />Customers with the information described above. San Francisco's failure to comply with the <br />requirements set forth in this section shall not invalidate any action taken by the Commission <br />(including, but not limited to, any rate increase or decrease adopted). In the event of such <br />failure, the Wholesale Customers may either invoke arbitration, as set forth in Section 8.01, or <br />seek injunctive relief, to compel San Francisco to remedy the failure as soon as is reasonably <br />practical, and San Francisco shall be free to oppose the issuance of the requested judicial or <br />arbitral relief on any applicable legal or equitable basis. The existence of this right to resort to <br />arbitration shall not be deemed to preclude the right to seek injunctive relief. <br />6. Because delays in the budget process or other events may cause San <br />Francisco to defer the effective date of Wholesale Customer rate adjustments until after the <br />beginning of San Francisco's fiscal year, nothing contained in this Agreement shall require San <br />Francisco to make any changes in the water rates charged to Wholesale Customers effective at <br />15118728.1 <br />407 <br />
