6.G. - Page 119 of 238 <br />Attachment A - Definitions <br />"1984 Agreement" refers to the 1984 Settlement Agreement and Master Water Sales Contract <br />between the City and County of San Francisco and certain Suburban Purchasers in San Mateo <br />County, Santa Clara County and Alameda County, which expires on June 30, 2009. <br />"Act" refers to the Raker Act, 38 Stat. 242, the Act of Congress, enacted in 1913, that <br />authorized the construction of the Hetch Hetchy system on federal lands. <br />"Adjusted Proportional Annual Use" means the respective percentages of annual water use, <br />as adjusted to reflect deliveries of water by the Hetch Hetchy Enterprise to outside City Retail <br />Customers. The adjustment is calculated each year as described in Section B of Attachment J <br />and is shown on lines 18 and 19 of Table 1 of that Attachment. <br />"Agreement" refers to this Water Supply Agreement, by and among San Francisco and the <br />Wholesale Customers who approve this Agreement in accordance with Section 1.03. <br />"BAWSCA" refers to the Bay Area Water Supply and Conservation Agency established <br />pursuant to Division 31 of the California Water Code (Water Code §§81300-81461) or its <br />successor and permitted assigns. <br />"CEQA" refers to the California Environmental Quality Act found at §§21000 et seq. of the <br />Public Resources Code and the Guidelines for the California Environmental Quality Act found at <br />§§15000 et seq. of Title 14 of the California Code of Regulations, as amended from time to time. <br />"Commission" means the governing board of the SFPUC, whose members, as of the date of <br />this Agreement, are appointed by the Mayor of San Francisco and confirmed by the San <br />Francisco Board of Supervisors. <br />"Compliance Audit" refers to the annual audit of the Wholesale Revenue Requirement by the <br />Compliance Auditor required by Sections 7.03 through 7.05. <br />"Compliance Auditor" refers to the independent certified public accountant chosen by the San <br />Francisco Controller to conduct each fiscal year's audit of the SFPUC's calculation of the <br />Wholesale Revenue Requirement as provided in Section 7.03.B. <br />15066183.1 <br />450 <br />
