Code § 27383. <br />IMPROVEMENT AGREEMENT <br />718 Canyon Road and 761, 763, and 765 Bain Place, Redwood City, CA 94064 <br />NJS 1 PROVEMENT AGREEMENT ("Agreement") is made and entered into on thi� day <br />of , 20 ("Effective Date") by and between by and between Ernst Develo anent <br />Cor op ation, a Californiar&rporation ("Developer"), and the CITY OF REDWOOD CITY, a <br />charter city and California municipal corporation ("City") with reference to the following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 0.80 acres located within the City of Redwood City, County of San Mateo, State of <br />California, described in Exhibit A, attached hereto and incorporated herein by reference (the "Property"). <br />B. On January 17, 2006, the Planning Commission of the City of Redwood City approved a <br />Tentative Parcel Map 2005-08 for 718 Canyon Road and 761, 763, and 765 Bain Place ("Project"), <br />prepared by MacLeod and Associates, Inc. and dated October, 2005 ("Tentative Map"), subject to certain <br />conditions of approval ("Conditions"). <br />C. The Conditions require either (1) that certain public improvements for the Project be <br />constructed prior to approval of the parcel map ("Final Map"), or (2) that Developer enter into an <br />agreement with City providing for the future construction of such public improvements. <br />D. Developer has submitted the Final Map and applied to City for Final Map approval <br />without having completed the required public improvements and, therefore, will enter into an agreement <br />with City providing for the future construction and installation of such public improvements, as required <br />by Government Code section 66462(a)(1). <br />E. Developer has submitted to City plans, specifications and drawings entitled 718 Canyon <br />Road Improvement Plans, prepared by MacLeod and Associates, and dated January 30, 2014 (the <br />"Improvement Plans"), which, in addition to other improvements, provide for certain on-site public <br />improvements consisting of street and street light improvements, storm drain systems, domestic water <br />systems and sanitary sewer systems for the Project (collectively, "Improvements"). <br />R Upon approval and recordation of the Final Map, the Property will be divided into four <br />residential lots hereinafter referred to as the "Residential Parcels". <br />G.
