Butler <br />1629 Main Street <br />Redwood City, CA 94063 <br />Attn: Gina Henson <br />City of Redwood City <br />1017 Middlefield Road <br />Redwood City, California 94063 <br />Attn: City Manager <br />Either Developer or City may designate, by not less than five (5) business days' notice <br />given to the other in accordance with the terms of this Section, additional or substituted <br />parties to whom Notices should be sent hereunder. <br />7. Runs with the Land; Recordation; City as Beneficiary. The City is an intended <br />beneficiary of this Deed Restriction. This Deed Restriction pertains to and shall run with the <br />Property for the benefit of the City. Developer agrees, for itself and its successors and assigns, <br />that in the event a court of competent jurisdiction determines that the covenants in this Deed <br />Restriction do not run with the land, such covenants shall be recorded as equitable servitudes <br />against the Property and the Project in favor of the City. Upon execution, this Deed Restriction <br />shall be recorded in the Official Records of San Mateo County. All of the terms, covenants and <br />conditions of this Deed Restriction shall be binding on and shall inure to the benefit of the <br />Developer and its nominees, successors and assigns. Wherever the term "Developer" is used <br />herein or therein, such term shall include any nominee, assignee or successor of the Developer. <br />8. This Deed Restriction shall be construed and interpreted in accordance with the <br />laws of California, excluding any choice of law rules which may direct the application of the <br />laws of another jurisdiction. In the event that any covenant or restriction herein contained is <br />invalid or is held to be invalid or void by any court of competent jurisdiction, such invalidity <br />shall in no way affect any other covenant or restriction herein contained.
