02/25/2019 RESOLUTION NO. 15738 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY SUMMARILY VACATING A BICYCLE AND PEDESTRIAN EASEMENT ON 600 BAIR ISLAND ROAD IN THE CITY OF REDWOOD CITY PURSUANT TO PART 3 OF DIVISION 9, CALIFORNIA STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA; DIRECTING THE CITY CLERK TO ACCEPT A NEW PUBLIC ACCESS EASEMENT IN EXCHANGE THEREOF; AND TO FILE SAID DEED FOR RECORDATION WHEREAS, pursuant to the provisions of Chapter 4, Part 3 (commencing at Section 8330) of Division 9 of the California Streets and Highways Code, the City Council of the City of Redwood City ("City Council") may summarily vacate public service easements, if such easements have been superseded by relocation and there are no other public service facilities located within the easement; and WHEREAS, the City Council hereby vacates the bicycle and pedestrian easement on 600 Bair Island Road located as shown on the Subdivision Map "Parcel Map No. 2011- 02" in Book 79 of Parcel Maps, at Pages 90-92, in the office of the Recorder for the County of San Mateo; and that bicycle and pedestrian easement to be vacated is attached hereto as Exhibit A and Exhibit B, incorporated herein by reference; and WHEREAS, because there are no in-place utilities that are in use, vacation of the bicycle and pedestrian easement is not subject to any reservations or exceptions; and WHEREAS, pursuant to Streets and Highways Code Section 8333, the easement has been superseded by relocation as described herein, and there are no other public facilities located within the easement; and WHEREAS, the property owner (Redwood City Hotels, LLC) proposes to offer for dedication to the City of Redwood City public access easement attached hereto as Exhibits A and B, incorporated herein by reference, in exchange for the bicycle and pedestrian easement to be vacated. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY AS FOLLOWS: 1. The recitals set forth above are true and correct, and are hereby incorporated herein by this reference as if fully set forth in their entirety. 2. That certain easement area shown on Exhibits "A and B" has been superseded by relocation, there are no other public service facilities located within the easement, and said easement is hereby ordered vacated.
