<br /> 6.1C <br /> Page 1 <br />R~J='()RT <br />June 19, 2006 <br />Su bject <br />Amendment No. 1 to the Consultant Agreement with Mark Thomas & Company, Inc. <br />relating to the Ralston Avenue/Marine Parkway/Route 101 Interchange Landscaping <br />Project. <br />Recommendation <br />Approve Amendment NO.1 to the agreement with Mark Thomas & Company, Inc., for <br />providing supplemental design and other support services for the Ralston <br />Avenue/Marine Parkway/Route 101 Interchange Landscaping Project, in an amount not <br />to exceed $16,500.00. <br />Background <br />On September 12, 2005, the City Council approved and authorized the execution of an <br />agreement with Mark Thomas & Company ("MTCo"), for providing design and related <br />support for the Ralston Avenue/Marine Parkway/Route 1 01 Interchange Landscaping <br />Project, in an amount not-to-exceed $59,060.00. <br />The roadway construction for this project is complete. This particular project deals only <br />with the landscaping of the interchange. The landscaping was originally part of the <br />main construction project; however, it was separated out at Caltrans' request. Caltrans <br />made this request due to the fact a 3-year maintenance period for new landscaping is <br />now required. This requirement is a hardship on most general contractors, because <br />bonds cannot be released during this period and the Association of General <br />Contractors' now has a Memorandum of Understanding with Caltrans not to hold bonds <br />for multiple years. <br />In designing this project, the project had to go through Caltrans' review, which we did <br />quite successfully. However, because Caltrans requested that we pull this portion of the <br />improvements out of the original project, and because this project is partially funded by <br />State grant funds, Caltrans' internal audit did not pass, since we started the project out <br />with landscaping and we ended up without landscaping. This necessitated a <br />Supplemental Project Report to explain the whole situation. We had to spend <br />resources writing this report for Caltrans, and getting it through the extensive review <br />process. <br /> Page 1 of 2 <br />
