development of the Property. City shall also timely fund and complete all physical improvements other than the Facilities necessary for the full development of the Property, which City customarily provides in connection with development at Redwood Shores. City represents and warrants that all off-site Facilities, including but not limited to water systems, storm systems, sanitary sewers, roadways, bridges and wastewater treatment plants which will serve the Property, have already been or will be constructed, or are presently available or will be timely available to accommodate Flatirons' full intended development of the Project in accordance with this Agreement without further obligation from Flatirons for payment thereof except as provided in subsection (e) of Section 9 and Section 14. (b) The Facilities to be timely constructed and paid for by City through District pursuant to this Agreement include, but are not limited to, improvements to provide adequate water supply to the Property; all necessary offsite traffic signals, public roadways and public roadway improvements; storm drainage facilities; sewer facilities and all other Facilities needed for the full development of the Project. If because of drought or other climatic conditions, the supply of water to all other existing and future water users in City is reduced or limited because of City-wide restrictions, then the supply of water to Flatirons will likewise proportionately be reduced or limited.
