<br />development of the Property. City shall also timely fund and complete all physical <br /> <br />improvements other than the Facilities necessary for the full development of the <br /> <br />Property, which City customarily provides in connection with development at <br /> <br />Redwood Shores. City represents and warrants that all off-site Facilities, including <br /> <br />but not limited to water systems, storm systems, sanitary sewers, roadways, bridges <br /> <br />and wastewater treatment plants which will serve the Property, have already been <br /> <br />or will be constructed, or are presently available or will be timely available to <br /> <br />accommodate Flatirons' full intended development of the Project in accordance <br /> <br />with this Agreement without further obligation from Flatirons for payment thereof <br /> <br />except as provided in subsection (e) of Section 9 and Section 14. <br /> <br />(b) <br /> <br />The Facilities to be timely constructed and paid for by City through <br /> <br /> <br />District pursuant to this Agreement include, but are not limited to, improvements <br /> <br />to provide adequate water supply to the Property; all necessary offsite traffic signals, <br /> <br />public roadways and public roadway improvements; storm drainage facilities; sewer <br /> <br />facilities and all other Facilities needed for the full development of the Project. If <br /> <br />because of drought or other climatic conditions, the supply of water to all other <br /> <br />existing and future water users in City is reduced or limited because of City-wide <br /> <br />restrictions, then the supply of water to Flatirons will likewise proportionately be <br /> <br />reduced or limited. <br /> <br />(c) <br /> <br />Except as provided in Sections 9 and 14: <br /> <br />(i) <br /> <br />City through District shall size the Facilities described in this <br /> <br />Section 8 sufficiently to serve the needs of the Project; and <br /> <br />-15- <br /> <br />DV AGR0'3.rxJC <br />August 26, 1996 <br />
