6.B. - Page 60 of 77 <br />RECORDING REQUESTED BY <br />AND WHEN RECORDED MAIL TO: <br />City Of Redwood City <br />1017 Middlefield Road <br />Redwood City, Ca 94063 <br />Attn: City Clerk <br />EXEMPT FROM RECORDING FEES PER <br />GOVERNMENT CODE §27383 <br />(SPACE ABOVE THIS LINE RESERVED FOR RECORDER'S USE) <br />CREEKSIDE TRAIL IMPROVEMENT, MAINTENANCE, AND PUBLIC ACCESS <br />EASEMENT AGREEMENT <br />This Creekside Trail Improvement, Maintenance, and Public Access Easement Agreement <br />(this "Agreement") is executed as of , 2019 (the "Effective Date") by and between <br />the City of Redwood City, a charter city and municipal corporation (the "City") and MP Bradford <br />Associates, L.P., a California limited partnership ("Developer"). City and Developer are <br />individually referred to herein as a "Party" and collectively referred to herein as the "Parties." <br />1. Authority; Definitions. This Agreement is executed pursuant to Section 5.22 of that certain <br />unrecorded Disposition and Development Agreement dated as of October 3rd, 2017, and executed <br />by and between the City and Developer (the "DDA"). Capitalized terms used without definition <br />in this Agreement shall have the meanings ascribed to such terms in the DDA. <br />2. Property. Pursuant to the DDA, City has conveyed to Developer certain real property, <br />including the land described in Exhibit A attached hereto ("Fee Parcel Al"). The property <br />described in Exhibit B attached hereto (the "Creekside Trail Parcel"), consisting of a portion of <br />the creek setback area for Redwood Creek, was conveyed to the City in trust, and remains subject to <br />certain reserved rights held by the State of California. The Improvements (described below) shall <br />be constructed and installed on the Creekside Trail Parcel and on the easternmost portion of Fee <br />Parcel A1, in the area depicted in Exhibit C. <br />3. Development of Publicly -Accessible Creekside Trail. By not later than , 20 , <br />Developer shall construct, install and complete, at Developer's sole cost and expense, the <br />improvements described in this Section (the "Improvements") in accordance with plans approved <br />by the City ("Improvement Plans"). Developer will supply all labor and materials necessary to <br />complete the Improvements. The Improvements shall include the construction of a publicly - <br />accessible creekside trail in the area depicted in Exhibit C, with all of the following features: <br />12' wide Concrete paved accessible trail adjacent to Redwood Creek from Main Street to <br />Bradford Street. The trail's creek edge will be a 2 -foot -wide decomposed granite shoulder <br />for joggers. Flow through planters and bike racks will be placed at the end of the trail near <br />Bradford Street. A concrete bench will be installed at the edges of the trail near Main Street. <br />Permanent signage will be located at each end of the trail. Both sides of the trail will be <br />bordered by a mix of creek tolerant trees and shrubs.
