City <br />1017 Middlefield Road <br />Redwood City, CA 94063 <br />Re: California Water Tank, Pump & Transmission Main Project <br />Anderson Pacific Engineering Construction lnc.'s Bid Protest <br />Dear Mr. Du: <br />I represent Anderson Pacific Engineering Construction Inc., (Anderson Pacific) regarding <br />the re bid for the California Water Tank, Puinp & Transmission Main Project (Project) for <br />Redwood City (City). Anderson Pacific protests the award of the contract to Disney <br />Construction Inc., (Disney) based on Public Contract Code section 5015 which prohibits a bidder <br />from rebidding a substantially similar project upon which it had previously "claimed" a mistake. <br />In December 2018, the City originally bid the project, but due to an error in its bid, <br />Disney sought relief under section 5103. The City granted Disney relief, but then rebid the <br />project this month. Section 5105 states: <br />A bidder who claims a mistake or who forfeits his or her bid security shall be <br />prohibited from participating in further bidding on the project on which the mistake <br />was claimed or security forfeited. <br />California law confirms that Disney is prohibited from participating in farther bidding of <br />this Project.
