<br />BOND NO.: 103 134982 <br />Premium: $2,910 <br /> <br />MAINTENANCE BOND <br /> <br />KNOW ALL MEN BY THESE PRESENTS, that we, Flatirons Funding, Limited Partnership, a <br /> <br />Delaware limited partnership, as Principals, and Travelers Casualty and Surety Company of <br /> <br />America, a corporation organized, existing under the laws of the State of Connecticut and duly <br /> <br />licensed to do business in the State of California, as Surety, are held and firmly bound unto the <br /> <br />City of Redwood City, as Obligee, in the penal sum of$194,000 (One Hundred Ninety-Four <br /> <br />Thousand Dollars) to which payment well and truly to be made we do bind ourselves, and each <br /> <br />of our heirs, executors, administrators, successors and assigns jointly and severally, firmly by <br /> <br />these presents. <br /> <br />WHEREAS, the said Principal entered into that certain Agreement for Improvement of <br /> <br />Electronic Arts Subdivision with the City of Redwood City dated March 18, 1997 (the <br /> <br />"Agreement") for certain grading and the construction of certain improvements in the Electronic <br /> <br />Arts Subdivision; <br /> <br />WHEREAS, the Agreement provides that the Principal will furnish a bond securing the faithful <br /> <br />performance by principal as owner of its obligations under paragraph 8 of the Agreement for a <br /> <br />period of one year after completion of said work and acceptance by the Obligee; and <br /> <br />WHEREAS, the work performed pursuant to the Agreement has been completed, and the <br /> <br />improvements have been accepted by the City of Redwood City on the 22nd day of March, 1999, <br /> <br />subject to receipt of a maintenance bond in the amount of$194,000. <br /> <br />350694-vlO064428-0032 <br />
