<br />improvements described as conditions of Electronic Arts Tentative Map No. TM <br /> <br />10801-3 and Planned Development Permit No. PD 10307-5; and <br /> <br />WHEREAS, the Plans and the Specifications are on file with the City Engineer <br /> <br />and are incorporated herein by this reference; <br /> <br />NOW, THEREFORE, in order to ensure satisfactory performance by Owner of <br /> <br />Owner's obligations under Chapter 30 of the Code of City ("Chapter 30"), being the <br /> <br />subdivision regulations of City, and in consideration of the approval of the Final <br /> <br />Map (including the dedication of streets and easements contained therein), <br /> <br />Subdivision, and in accordance with the conditions of approval of the Vesting <br /> <br />Tentative Map, the parties hereto agree as follows: <br /> <br />1. <br /> <br />IMPROVEMENTS. Owner shall, at Owner's own cost and expense, (a) <br /> <br />perform the grading; (b) construct the Improvements, (c) perform such other related <br /> <br />work as may reasonably be determined by the City Engineer as necessary to complete <br /> <br />the Grading and the Improvements (the "Related Work"); and (c) furnish the labor <br /> <br />and materials required by the Grading, the Improvements, and the Related Work <br /> <br />(the "Labor and Materials"), all in accordance with, and as provided for in, the Plans <br /> <br />and Specifications and in accordance with, and as provided for in, City's <br /> <br />specifications entitled "Engineering Standards -- City of Redwood City," adopted on <br /> <br />December 16, 1991, and on file in the office of the City Engineer. The Grading, the <br /> <br />Improvements, and the Related Work must be constructed in strict compliance with <br /> <br />the provisions of Chapter 30. To the extent that a conflict exists between the Plans <br /> <br />and Specifications and Chapter 30 in regard to the standard for the Grading, a <br /> <br />particular Improvement, or the Related Work, the stricter standard governs.
