Any part of the Deposit or such additional sum or sums not utilized by <br /> <br />City shall be returned promptly to Ground Lessee. <br /> <br />10. <br /> <br />Reimbursement for Redwood Shores Right-Turn <br /> <br />Lane <br /> <br />Construction. City and Ground Lessee agree that City will include in the <br /> <br />Redwood Shores Parkway widening project the construction of the right-turn lane <br /> <br />to the Spieker Properties Site. For the purpose of reimbursing the City the <br /> <br />construction cost of the right-turn lane, Ground Lessee shall deposit Thirty Five <br /> <br />Thousand and No/100 Dollars ($35,000.000) in cash. The final accounting shall <br /> <br />be based on the actual construction and design cost of the work and it will be <br /> <br />determined at the completion of the project. If the construction cost exceeds <br /> <br />$35,000.00 additional monies shall be paid to the City by the Ground Lessee. If <br /> <br />it is less than $35,000.00 the City shall reimburse the Ground Lessee the <br /> <br />difference between the actual cost and the deposited $35,000.00. <br /> <br />11. Time Extensionsllmmunitv from Acts of God.
