<br />the approval of the improvements for the Property, the parties hereto agree as <br /> <br />follows: <br /> <br />1. Improvements. <br /> <br />Ground Lessee shall, at its own cost and expense, <br /> <br />construct all of the improvements ("Improvements"), furnish all the material s, and <br /> <br />do all the work hereinafter described in accordance with, and as provided for in, <br /> <br />the plans prepared by Brian Kangas Foulk, Civil Engineers, entitled, <br /> <br />"Improvement Plans - Towers @ Shores Center," as well as City's revised <br /> <br />specifications entitled, "Engineering Standards of the City of Redwood City", <br /> <br />adopted January 5, 1998 which plans and specifications are on file in the office <br /> <br />of the Manager, Engineering and Construction. Said Improvements shall also be <br /> <br />constructed in strict compliance with the provisions of Article VII, Chapter 29 of <br /> <br />the Code of the City of Redwood City. If a conflict exists between the plans and <br /> <br />specifications and said Chapter 29 in regard to the standard for a particular <br /> <br />improvement, the stricter standard shall govern to the extent of such conflict. <br /> <br />Ground Lessee shall complete all of the Improvements, subject to such <br /> <br />exceptions and time extensions allowable under paragraph 10, on or before <br /> <br />August 14, 2002. <br /> <br />The Improvements shall include, but are not necessarily <br /> <br />limited to, all of the following: <br /> <br />(a) <br />(b) <br /> <br />grading, paving <br /> <br />curbs, gutters, sidewalks <br /> <br />(c) <br /> <br />water system modifications, complete <br /> <br />(d) <br /> <br />sewer system, complete <br /> <br />(e) landscaping and irrigation system, complete <br />F:\shared\Redwood\Council 2 <br />Agmt-375 <br />FXS:ep <br />07/27/00, 08/02/00R, 08/14/00RR 111111111111111111111111111111111111111111111111111111\ <br /> <br />2000-116763 <br />09/20/2000 11 :24A <br />AG Page: 3 of 14 <br />
