On the date of recordation of this Offer and Agreement, Flatirons is the <br />owner of that certain real property located in the City as more particularly described <br />in Exhibit A attached hereto (the "Property"). <br /> <br />B. In connection with the development of the Electronic Arts <br />Headquarters Campus (the "Project") on the Property, Flatirons desires to offer to <br />dedicate to the City, its successors and assigns, upon completion of the Easement <br />Improvement (as defined in Section 1 below) a non-exclusive easement in gross (the <br />"Easement") solely and exclusively for the easement use as defined in Section 1 <br />below (the "Easement Use") over those certain and limited portions of the Property <br />as described in Exhibit B attached hereto (the "Easement Area"). For purposes of the <br />Easement granted in this Offer and Agreement, the Property is the servient <br />tenement. <br /> <br />C. Flatirons proposes to construct, or cause to be constructed, a pedestrian <br />sidewalk within the Easement Area.
