<br />RECORDING REQUESTED BY, AND <br />WHEN RECORDED MAIL TO: <br /> <br />Arlen Jorgenson <br />City Clerk <br />City of Redwood City <br />1020 Middlefield Road <br />Redwood City, CA 94063 <br /> <br />FIRST AMENDMENT TO DEVELOPMENT AGREEMENT <br /> <br />This First Amendment to Development Agreement ("Amendment") is made <br />°jJ <br />and entered into this bt/.. day of'!!:, 1998, by and between the City of Redwood City, a <br /> <br />municipal corporation of the State of California ("City"), Flatirons Funding, Limited <br /> <br />("Electronic Arts") in its capacity as a guarantor of Flatirons' obligations under the <br /> <br /> <br />Partnership, a Delaware limited partnership ("Flatirons"), and Electronic Arts Inc. <br /> <br />Development Agreement (as hereinafter defined) under Section 41 of that <br /> <br />agreement. <br /> <br />RECITALS <br /> <br />THIS AMENDMENT is predicated on the following facts: <br /> <br />A. <br /> <br />Flatirons, the City, and Electronic Arts are parties to the Development <br /> <br />Agreement entered into on November 7, 1996, by and between the City, Flatirons, <br /> <br />and Electronic Arts and recorded in the official records of San Mateo County on <br /> <br />November 8, 1996 as Instrument No. 96-138988 (the "Development Agreement") <br /> <br />which encumbers the Property (as hereinafter defined). <br />
