<br />DES:djk n7/07/98 <br /> <br />(013/70) <br /> <br />emergency access <br /> <br />road <br /> <br />(the <br /> <br />"Road") <br /> <br />from East Bayshore <br /> <br />Road to <br /> <br />Blomquist Street; <br /> <br />NOW, THEREFORE, in order to ensure satisfactory performance <br /> <br />by Owner of Owner's obligations under Chapter 30 of the Code of <br /> <br />the City of Redwood City, <br /> <br />being the subdivision regulations of <br /> <br />said City, and in consideration of the approval of the final map <br /> <br />(including the dedication of easements contained therein) for the <br /> <br />subdivision, and in accordance with the conditions of approval of <br /> <br />the tentative map for the subdivision, the parties hereto agree <br /> <br />as follows: <br /> <br />1. <br /> <br />IMPROVEMENTS. <br /> <br />Owner <br /> <br />shall, <br /> <br />at <br /> <br />Owner's <br /> <br />own <br /> <br />cost <br /> <br />and <br /> <br /> <br />expense, <br /> <br />construct <br /> <br />all <br /> <br />of <br /> <br />the <br /> <br />improvements <br /> <br />("Improvements") , <br /> <br />furnish <br /> <br />all <br /> <br />the <br /> <br />materials, <br /> <br />and <br /> <br />do <br /> <br />all <br /> <br />the <br /> <br />work <br /> <br />hereinafter <br /> <br />described, <br /> <br />in accordance with, and as provided for in the plans <br /> <br />prepared <br /> <br />for <br /> <br />Owner <br /> <br />by <br /> <br />Brian <br /> <br />Kangas <br /> <br />Foulk, <br /> <br />Civil <br /> <br />Engineers, <br /> <br />entitled, <br /> <br />"Plans for the Improvement of California Marina", <br /> <br />and <br /> <br />in <br /> <br />accordance <br /> <br />with <br /> <br />and <br /> <br />as <br /> <br />provided <br /> <br />for, <br /> <br />in <br /> <br />those <br /> <br />certain <br /> <br />specifications <br /> <br />entitled, <br /> <br />"Supplemental <br /> <br />Specifications <br /> <br />for <br /> <br />Civil/Landscape/Irrigation <br /> <br />Improvements", <br /> <br />as <br /> <br />well <br /> <br />as <br /> <br />City's <br /> <br />revised specifications entitled, "Engineering Standards - City of <br /> <br />Redwood <br /> <br />City" , <br /> <br />adopted <br /> <br />January <br /> <br />5, <br /> <br />1998, <br /> <br />which <br /> <br />plans <br /> <br />and <br /> <br />specification are on <br /> <br />file <br /> <br />in the office of the City Engineer. <br /> <br />Said Improvements shall also be constructed in strict compliance <br /> <br />wi th the provisions of Chapter 30 <br /> <br />of the Code of the City of <br /> <br />Redwood City, <br /> <br />the subdivision regulations of said City. <br /> <br />To the <br /> <br />extent <br /> <br />that <br /> <br />a <br /> <br />conflict <br /> <br />exists <br /> <br />between <br /> <br />the <br /> <br />plans <br /> <br />and <br /> <br />2 <br />
