<br />4. <br /> <br />Change in Master Plan. <br /> <br />The Master Plan attached as Exhibit H to the Development Agreement is <br /> <br />hereby deleted in its entirety and replaced in its entirety by Exhibit H attached hereto <br /> <br />and made a part hereof, with the same legal effect as if it had been originally <br /> <br />attached to the Development Agreement. <br /> <br />5. <br /> <br />Change in Planned Development Permit No. PDI0307-5. <br /> <br />Planned Development Permit No. PD10307-5 attached as Exhibit I to the <br /> <br />Development Agreement is hereby deleted in its entirety and replaced in its entirety <br /> <br />by Exhibit I attached hereto and made a part hereof, with the same legal effect as if it <br /> <br />had been originally attached to the Development Agreement. <br /> <br />6. <br /> <br />Change of Legal Description of the Property. <br /> <br />The legal description of the Property set forth in Exhibit D to the First <br /> <br /> <br />Amendment to the Development Agreement which replaced Exhibit J to the <br /> <br />Development Agreement is hereby deleted in its entirety and replaced in its entirety <br /> <br />to read in the form of Exhibit J attached hereto and made a part hereof, with the <br /> <br />same legal effect as if it had been originally attached to the Development <br /> <br />Agreement. <br /> <br />7. <br /> <br />Guarantee of Treatment Capacity. <br /> <br />(a) <br /> <br />Section 14(a)(i) and Section 14(a)(ii) of the Development Agreement are <br /> <br />deleted in their entirety and replaced with the following: <br /> <br />"(a) City and City through District acknowledge and <br />agree that: <br /> <br />(i) Redwood Shores Properties ("RSP") as the <br />successor in interest to Mobil Oil Estates <br /> <br />-7- <br /> <br />2DAAMND8.DOC <br />
