<br />DES:djk 04/1b/~b <br /> <br />lUU4/ 'UJ <br /> <br />(including the dedication of right-of-way contained therein) <br /> <br />for <br /> <br />the <br /> <br />subdivision, <br /> <br />and <br /> <br />in <br /> <br />accordance <br /> <br />with <br /> <br />the <br /> <br />conditions <br /> <br />of <br /> <br />approval of the tentative parcel map <br /> <br />for the subdivision, <br /> <br />the <br /> <br />parties hereto agree as follows: <br /> <br />1. <br /> <br />IMPROVEMENTS. <br /> <br />Owner <br /> <br />shall, <br /> <br />at <br /> <br />Owner's <br /> <br />own <br /> <br />cost <br /> <br />and <br /> <br />expense, <br /> <br />construct <br /> <br />all <br /> <br />of <br /> <br />the <br /> <br />improvements <br /> <br />("Improvements") , <br /> <br />furnish <br /> <br />all <br /> <br />the <br /> <br />materials, <br /> <br />and <br /> <br />do <br /> <br />all <br /> <br />the <br /> <br />work <br /> <br />hereinafter <br /> <br />described, in accordance with, and as provided for in the plans <br /> <br />prepared <br /> <br />for <br /> <br />Owner <br /> <br />by <br /> <br />Lea <br /> <br />& <br /> <br />Sung <br /> <br />Engineering, <br /> <br />Inc. , <br /> <br />Civil <br /> <br />Engineers, <br /> <br />entitled, <br /> <br />"Plans for the Improvements of Parcel Map <br /> <br />93-5", <br /> <br />and those certain specifications entitled, <br /> <br />"Engineering <br /> <br />Standards - City of Redwood City", adopted December 16, 1991, on <br /> <br />file in the office of the City Engineer. <br /> <br />Said Improvements shall <br /> <br />also be constructed in strict compliance with the provisions of <br /> <br />subdivision <br /> <br />regulations <br /> <br />of <br /> <br />said <br /> <br />City. <br /> <br />To <br /> <br />the <br /> <br />extent <br /> <br />that <br /> <br />a <br /> <br /> <br />Chapter <br /> <br />30 <br /> <br />of <br /> <br />the <br /> <br />Code <br /> <br />of <br /> <br />the <br /> <br />City <br /> <br />of <br /> <br />Redwood <br /> <br />City, <br /> <br />the <br /> <br />conflict exists between the plans <br /> <br />and specifications and <br /> <br />said <br /> <br />Chapter <br /> <br />30 <br /> <br />in <br /> <br />regard <br /> <br />to <br /> <br />the <br /> <br />standard <br /> <br />for <br /> <br />a <br /> <br />particular <br /> <br />improvement, <br /> <br />the <br /> <br />stricter <br /> <br />standard <br /> <br />shall <br /> <br />govern. <br /> <br />Owner <br /> <br />shall <br /> <br />complete <br /> <br />all <br /> <br />of <br /> <br />the <br /> <br />Improvements, <br /> <br />subject <br /> <br />to <br /> <br />time <br /> <br />extensions <br /> <br />allowable under paragraph II, <br /> <br />on or before September 1, <br /> <br />1998. <br /> <br />The Improvements shall include, but are not necessarily limited <br /> <br />to, all of the following: <br /> <br />(a) grading, paving <br />(b) curb, gutter, sidewalk, driveway <br />(c) sanitary sewer system, complete <br />(d) water system, complete <br />(e) storm drainage system, complete <br /> <br />2 <br />
