<br />(2e1v m -to ~ <br /> <br />c1í'fCL~ <br />err< \tALL <br />F O,ß<I,it..39 t <br />1020 MIODLEFIELD ROAD <br />REDWOOD CITY, CA 94064 , <br /> <br />ORIGINAL <br />AGREEMENT <br />FOR <br />IMPROVEMENT OF ELECTRONIC ARTS SUBDIVISION <br /> <br />THIS AGREEMENT is entered into as of the lr"'day of <br /> <br />\'V\ l\ d~997, <br /> <br />by and between the CITY OF REDWOOD CITY, a municipal corporation of the State <br /> <br />of California ("City"), and FLATIRONS FUNDING, LIMITED PARTNERSHIP, a <br /> <br />Delaware limited partnership ("Owner"); <br /> <br />t- <br /> <br />WITNESSETH: <br /> <br />WHEREAS, Owner is engaged in subdividing and developing that certain <br /> <br />subdivision known as Electronic Arts (the "Subdivision"), situated in the City of <br /> <br />Redwood City, County of San Mateo, State of California; and <br /> <br />WHEREAS, the City Engineer has determined that the final map (the "Final, <br /> <br />WHEREAS, the grading of the Subdivision (the "Grading"), and the <br /> <br /> <br />Map") for the Subdivision conforms to the vesting tentative map (the "Vesting <br /> <br />Tentative Map") for the Subdivision; and <br /> <br />construction of certain public improvements (the "Improvements") are required as <br /> <br />a condition of approval of the Vesting Tentative Map; and <br /> <br />WHEREAS, Owner has requested that the Final Map be approved prior to the <br /> <br />Grading and the construction and completion of the Improvements, and the <br /> <br />Grading is to be performed, and the Improvements are to be constructed in <br /> <br />accordance with, and as required by, the plans entitled "Electronic Arts Shoreline <br /> <br />Drive Extension" (the "Plans") dated 3,- JSJ -11 and specifications entitled <br /> <br />"Electronic Arts Technical Specifications" (the "Specifications") dated <br />~ -)1)- 4.:1 prepared for Owner by Bohley /Maley Associates and all <br /> <br />EASUBAG5.DOC <br />2/13/97 12:14 PM <br />
