<br />DES:djk 1)1/24/97 <br /> <br />(027a/70) <br /> <br />subdivision, and in accordance with the conditions of approval of <br /> <br />the tentative map for the subdivision, the parties hereto agree <br /> <br />as follows: <br /> <br />1. <br /> <br />IMPROVEMENTS. <br /> <br />Owner <br /> <br />shall, <br /> <br />at <br /> <br />Owner's <br /> <br />own <br /> <br />cost <br /> <br />and <br /> <br />expense, <br /> <br />construct <br /> <br />all <br /> <br />of <br /> <br />the <br /> <br />improvements <br /> <br />("Improvements") , <br /> <br />furnish <br /> <br />all <br /> <br />the <br /> <br />materials, <br /> <br />and <br /> <br />do <br /> <br />all <br /> <br />the <br /> <br />work <br /> <br />hereinafter <br /> <br />described, <br /> <br />in accordance with, and as provided for in the plans <br /> <br />prepared for Owner by Bohley Maley Associates, Consulting Civil <br /> <br />Engineers, <br /> <br />entitled, <br /> <br />"Lido <br /> <br />Neighborhood <br /> <br />Unit <br /> <br />No. <br /> <br />4 <br /> <br />Mitigation <br /> <br />Channel", <br /> <br />and in accordance with and as provided for, <br /> <br />in those <br /> <br />certain specifications entitled, "Supplemental Specifications for <br /> <br />Civil/Landscape/Irrigation <br /> <br />Improvements", <br /> <br />as <br /> <br />well <br /> <br />as <br /> <br />City's <br /> <br />specifications entitled, "Engineering Standards - City of Redwood <br /> <br />are <br /> <br />on <br /> <br />file <br /> <br />in <br /> <br />the <br /> <br />office <br /> <br />of <br /> <br />the <br /> <br />City <br /> <br />Engineer. <br /> <br />Said <br /> <br /> <br />City", <br /> <br />adopted December 16, <br /> <br />1991, which plans and specification <br /> <br />Improvements shall also be constructed in strict compliance with <br /> <br />the provisions of Chapter 30 of the Code of the City of Redwood <br /> <br />City, <br /> <br />the <br /> <br />subdivision regulations <br /> <br />of <br /> <br />said City. <br /> <br />To the extent <br /> <br />that if a conflict exists between the plans and specifications <br /> <br />and said Chapter 30 in regard to the standard for a particular <br /> <br />improvement, <br /> <br />the <br /> <br />stricter <br /> <br />standard <br /> <br />shall <br /> <br />govern. <br /> <br />Owner <br /> <br />shall <br /> <br />complete all of the Improvements, subject to such exceptions and <br /> <br />time extensions allowable under paragraph 11, on or before March <br /> <br />1, 1999. The Improvements shall include, but are not necessarily <br /> <br />limited to, all of the following: <br /> <br />( a) <br /> <br />grading and drainage <br /> <br />(b) <br /> <br />rock slope protection, complete <br /> <br />(c) <br /> <br />pedestrian bridge, complete <br /> <br />2 <br />
