<br />DES:djJr 11/07/96 <br /> <br />(007/72) <br /> <br />said City, and in consideration of the approval of the final map <br /> <br />(including the dedication of easements contained therein) for the <br /> <br />subdivision, and in accordance with the conditions of approval of <br /> <br />the tentative map for the subdivision, the parties hereto agree <br /> <br />as follows: <br /> <br />1: <br /> <br />IMPROVEMENTS. <br /> <br />Owner <br /> <br />shall, <br /> <br />at Owner's <br /> <br />own <br /> <br />cost <br /> <br />and <br /> <br />expense, <br /> <br />construct <br /> <br />all <br /> <br />of <br /> <br />the <br /> <br />improvements <br /> <br />( "Improvements") , <br /> <br />furnish <br /> <br />all <br /> <br />the <br /> <br />materials, <br /> <br />and <br /> <br />do <br /> <br />all <br /> <br />the <br /> <br />work <br /> <br />hereinafter <br /> <br />described, in accordance with, and as provided for in the plans <br /> <br />prepared <br /> <br />for <br /> <br />Owner <br /> <br />by <br /> <br />Brian <br /> <br />Kangas <br /> <br />Foulk, <br /> <br />Civil <br /> <br />Engineers, <br /> <br />entitled, <br /> <br />"Improvement <br /> <br />Plans <br /> <br />for <br /> <br />Jefferson <br /> <br />Estates", <br /> <br />and <br /> <br />in <br /> <br />accordance <br /> <br />with <br /> <br />and <br /> <br />as <br /> <br />provided <br /> <br />for, <br /> <br />in <br /> <br />those <br /> <br />certain <br /> <br />specifications <br /> <br />entitled, <br /> <br />"Supplemental <br /> <br />Specifications <br /> <br />for <br /> <br /> <br />Civil/Landscape/Irrigation <br /> <br />Improvements", <br /> <br />as <br /> <br />well <br /> <br />as <br /> <br />City's <br /> <br />specifications entitled, "Engineering Standards - City of Redwood <br /> <br />City", adopted December 16, 1991, which plans and specification <br /> <br />are <br /> <br />on <br /> <br />file <br /> <br />in <br /> <br />the <br /> <br />office <br /> <br />of <br /> <br />the <br /> <br />City <br /> <br />Engineer. <br /> <br />Said <br /> <br />Improvements shall also be constructed in strict compliance with <br /> <br />the provisions of Chapter 30 of the Code of the City of Redwood <br /> <br />City, <br /> <br />the subdivision regulations of said City. <br /> <br />To the extent <br /> <br />that a conflict exists between the plans and specifications and <br /> <br />said <br /> <br />Chapter <br /> <br />30 <br /> <br />in <br /> <br />regard <br /> <br />to <br /> <br />the <br /> <br />standard <br /> <br />for <br /> <br />a <br /> <br />particular <br /> <br />improvement, <br /> <br />the <br /> <br />stricter <br /> <br />standard <br /> <br />shall govern. <br /> <br />Owner <br /> <br />shall <br /> <br />complete <br /> <br />all <br /> <br />of <br /> <br />the <br /> <br />Improvements, <br /> <br />subject <br /> <br />to <br /> <br />time <br /> <br />extensions <br /> <br />allowable under paragraph 11, on or before December 1, 1998.
