<br />JAH:dft <br /> <br />9/~O/94R (OO2/STINEl) <br /> <br />California <br /> <br />( "City") <br /> <br />effective the 1st day of November, <br /> <br />1994, as <br /> <br />from <br /> <br />time <br /> <br />to <br /> <br />time <br /> <br />amended <br /> <br />(the <br /> <br />"Agreement") , <br /> <br />until <br /> <br />the <br /> <br />recordation <br /> <br />by <br /> <br />the <br /> <br />Grantor <br /> <br />of <br /> <br />the <br /> <br />Certificate <br /> <br />of <br /> <br />Completion <br /> <br />described in Section 519 of the Agreement, at which time only the <br /> <br />covenants against discrimination set forth in the final paragraph <br /> <br />of this Grant Deed shall survive. <br /> <br />The Grantor has <br /> <br />the <br /> <br />limi ted and cond i tional right to the <br /> <br />return <br /> <br />of <br /> <br />title <br /> <br />and <br /> <br />possession <br /> <br />of <br /> <br />the <br /> <br />Property <br /> <br />and <br /> <br />all <br /> <br />improvements thereon, and to the termination and revesting in the <br /> <br />Grantor of the estate conveyed to the Grantee hereby, <br /> <br />as <br /> <br />such <br /> <br />right is set forth in Section 810 of the Agreement; provided that <br /> <br />such <br /> <br />right <br /> <br />to <br /> <br />reenter, <br /> <br />take <br /> <br />possession, <br /> <br />terminate <br /> <br />and <br /> <br />revest <br /> <br />shall <br /> <br />expire <br /> <br />and <br /> <br />be <br /> <br />of <br /> <br />no <br /> <br />further <br /> <br />force <br /> <br />or <br /> <br />effect <br /> <br />upon <br /> <br />the <br /> <br /> <br />recordation by the Grantor of the Certificate of Completion. <br /> <br />The Grantee herein covenants by and for itself, <br /> <br />its heirs, <br /> <br />executors, <br /> <br />administrators and assigns, <br /> <br />and all persons claiming <br /> <br />under <br /> <br />or <br /> <br />through <br /> <br />them, <br /> <br />that <br /> <br />there <br /> <br />shall <br /> <br />be <br /> <br />no <br /> <br />discrimination <br /> <br />against or <br /> <br />segregation <br /> <br />of, <br /> <br />any person <br /> <br />or group of persons <br /> <br />on <br /> <br />account of race, <br /> <br />color, <br /> <br />creed, <br /> <br />religion, <br /> <br />handicap, <br /> <br />sex, <br /> <br />sexual <br /> <br />preference, <br /> <br />marital status, <br /> <br />national origin or ancestry in the <br /> <br />sale, <br /> <br />lease, <br /> <br />sublease, <br /> <br />transfer, <br /> <br />use, <br /> <br />occupancy, <br /> <br />tenure <br /> <br />or <br /> <br />enjoyment of the premises herein conveyed, nor shall the Grantee <br /> <br />or any person claiming under or through the Grantee, establish or <br /> <br />permit <br /> <br />any <br /> <br />such <br /> <br />practice <br /> <br />or <br /> <br />practices <br /> <br />of <br /> <br />discrimination <br /> <br />or <br /> <br />segregation with reference <br /> <br />to the <br /> <br />selection, <br /> <br />location, <br /> <br />number, <br /> <br />use or occupancy of tenants, <br /> <br />lessees, <br /> <br />subtenants, <br /> <br />sublessees or <br /> <br />2 of 4 <br />
