Code § 27383. <br />IMPROVEMENT AGREEMENT <br />340 West Oakwood Blvd. <br />THIS IMPROVEMENT AGREEMENT ("Agreement") is made and entered into on this - day of - <br />12� ice2018 ("Effective Date") by and between by and between Michael L. Cocco, Judith <br />A. Cocco, and Bethany Sue Chaney, Trustee of the Bethany Sue Chaney 2005 Living Trust <br />("Developer"), and the CITY OF REDWOOD CITY, a charter city and California municipal <br />corporation ("City") with reference to the following facts: <br />RECITALS <br />A . Developer is the current fee owner of that certain real property consisting of <br />approximately 0.42 acres located within the City of Redwood City, County of San Mateo, State of <br />California, described in Exhibit A, attached hereto and incorporated herein by reference (the "Property"). <br />B . On April 19'h, 2018, the Subdivision Committee of the City of Redwood City approved <br />a Vesting Tentative Parcel Map for 340 West Oakwood Blvd. (TM2017-004) ("Project"), prepared by <br />MacLeod and Associates and dated February 21", 2018 ("Tentative Parcel Map"), subject to certain <br />conditions of approval ("Conditions"). <br />C . The Conditions require either (1) that certain public improvements for the Project be <br />constructed prior to approval of the Parcel Map ("Parcel Map"), or (2) that Developer enter into an <br />agreement with City providing for the future construction of such public improvements. <br />D . Developer has submitted the Parcel Map and applied to City for Parcel Map approval <br />without having completed the required public improvements and, therefore, will enter into an agreement <br />with City providing for the future construction and installation of such public improvements, as required <br />by Government Code section 66462(a)(1). <br />E . Developer has submitted to City plans, specifications and drawings entitled On-site and <br />Off-site Improvement Plans 340 W. Oakwood Blvd., prepared by MacLeod and Associates and dated <br />October 15, 20 18 (the "Improvement Plans'), which, in addition to other improvements, provide for <br />certain on-site public improvements consisting of domestic water systems for the Project (collectively, <br />"Improvements"). <br />F .
