Second Violation: Except as otherwise set forth in Section 2 above, for an offense classified as an infraction, the fine amount for a second violation of the same code section by the same person within a twelve (12) month period shall be one hundred twenty-five percent (125%) of the fine amount set forth in this Resolution for a first violation, or $200, whichever is less. Except as otherwise set forth in Section 2 above, for an offense classified as a misdemeanor, the fine amount for a second violation of the same code section by the same person within a twelve (12) month period shall be one hundred twenty- five percent (125%) of the fine amount set forth in this Resolution for a first violation, or $1,000, whichever is less. SECTION 4. Third Violation: Except as otherwise set forth in Section 2 above, for an offense classified as an infraction, the fine amount for a third violation and subsequent violations of the same code section by the same person within a twelve (12) month period (starting with the date of service of the first violation) shall be one hundred fifty percent (150%) of the fine for a first violation or $500, whichever is less.
