and 27.5 thereto, but to take into consideration the lapse of time following the effective date of said ordinance, which effectively provided the existing sexually oriented business the opportunity to relocate to conform to the provisions of Article 27; NOW, THEREFORE; BE IT RESOLVED ElY THE COUNCIL OF THE CITY OF REDWOOD CITY, AS FOLLOWS: 1. Pursuant to the provisions of Section 41.2a of Ordinance No. 1130, as amended, (the "Zoning Ordinance"), this Council hereby expresses its intention to amend Article 27 of the Zoning Ordinance by adding Sections 27.4 and 27.5 thereto to read as follows: "Section 27.4. Amortization of Nonconformin.q Sexually Oriented Business Uses. Any use of real property existing on the date the ordinance adding this Section to Article 27 becomes effective that does not conform to the provisions of Section 27.3, but was operated and maintained in compliance with all previous regulations, shall be rega,ded a~ a nonconforming use that may be continued for six (6) months after said effective date. On or before such date, all such nonconforming uses shall be terminated unless an extension of time has been approved by the City Council in accordance with the provisions of Section 27.5. (a) Abandonment. Notwithstanding the above, any discontinuance or abandonment of the use of any lot or structure as a sexually oriented business shall result in the loss of legal nonconforming status of such use. (b) Amortization--annexed property. Any sexually oriented business which was a legal use at the time of annexation to the City of the property on which it is located, but which does not conform to the provisions of Section 27.3, shall be terminated within six (6) months of the date of annexation unless an extension of time has been approved by the City Council in accordance with the provisions of Section 27.5."
