REPORT

7A
Page 1

To the Honorable Mayor and City Council
From the City Manager

September 25, 2006

Subject
Future Solid Waste, Recycling, and Organics Collection Programs and Future Franchise
Agreement

Recommendation
It is recommended that Council provide the City's representative on the South Bayside
Waste Management Authority (SBWMA) Board of Directors with direction on how to
represent the Council's interests on the items remaining outstanding from the August 28,
2006 Council meeting.

Background
At the August 28, 2006 Council meeting, staff presented a report concerning important
issues and choices for future solid waste, recycling, and organics collection programs and
future franchise agreement. A copy of this staff report is attached for your review
(Attachment 1). At the conclusion of this meeting, Council requested further information
and clarification on the following items:
. Labor policies
. The proposed code of good conduct
. Alternative fuel vehicles
. SBWMA ownership of and leasing of collection vehicles

Subsequent to the August 28 Council meeting, at the suggestion of the City Manager,
Mayor Pierce appointed a Council subcommittee to meet with staff to explore solutions to
the above items. Mayor Pierce nominated herself and Council Member Jim Hartnett to
serve on this subcommittee. This subcommittee then met with staff on September 7 to
explore the above items in more detail.

Labor Policies
Establishing labor policies in the request for proposal is an important consideration as it
provides direction to proposers on how the SBWMA and franchising agencies desire to
have existing and new workers' conditions of employment provided. The SBWMA Process
and Contracts Subcommittee met with representatives of Teamsters Local 350, the
collective bargaining agent for the current drivers at Allied Waste Industries. As a result of
these meetings and information provided by Local No. 350 to the SBWMA and to the City
Council, staff views labor policies falling into the following four categories:
. Salaries and benefits
. Worker retention
. Provisions for selecting a collective bargaining representative (Card Check
Agreement)
. Labor peace
