and, except as otherwise provided by the Act, the election shall be conducted in accordance with the provisions of law regulating elections of the City ,of Redwood City insofar as such provisions are determined by the City Clerk to be applicable. It is hereby found that fewer than 12 persons have been registered to vote within the territory of the District for each of the 90 days preceding the close of the April 26, 1999 hearing on the formation of the District. Pursuant to Section 53326(b) of the Act, the vote shall be by the landowners of the District and each person who is the owner of record as of the close of the April 26, 1999 hearing regarding the formation of the District, or the authorized representative thereof, shall have one vote for each acre or portion of an acre of land that he or she owns within the District. The number of votes to be voted by each particular landowner shall be specified on the ballot provided to that landowner. The ballots for the special election shall be distributed to qualified electors by mail with return postage prepaid or by personal service by the City Clerk. The voted ballots shall be returned to the City Clerk not later than 4:00 p.m. on July 30, 1999; provided, however, that the election shall be closed at such earlier time as all qualified electors have voted as provided in Section 53326(d) of the Act. SECTION 13. The preparation of the Report and the preparation of the Revised Report are hereby ratified. The Report and the Revised Report, as submitted, are hereby approved and are made a part of the record of the public hearing regarding the formation of the District, and are ordered to be kept on file with the transcript of these, proceedings and open for public inspection. SECTION 14. Attached hereto as Exhibit B are (1) a proposed form of a joint community facilities agreement, to be dated its date of execution (the "Belmont Agreement"), by and between the City and the City of Belmont ("Belmont") and (2)a proposed form of a joint community facilities agreement, to be dated its date of eXeCUtion (the "CalTrans Agreement"), by and between the City and the California Department of Transportation ("CalTrans"). Pursuant to Section 53316.2 of the Act, the City Council hereby approves the proposed forms of the Belmont Agreement and the CalTrans Agreement (collectively, the "Joint Community Facilities Agreements"), determines that the Joint Community Facilities Agreements will be beneficial to the residents of the City, and authorizes and directs the City Manager, for and in the name and on behalf of the City, to execute and deliver the Joint Community Facilities Agreements in the forms attached hereto, with such additions thereto or changes therein as the City Manager, with the advice of the City Attorney, may require or approve, such approval to be conclusively evidenced by the execution and delivery thereof. The City Manager, for and in the name and on behalf of the City, is further authorized to execute and deliver an amendment to the Belmont Agreement following the original execution and delivery of the Belmont Agreement to add CalTrans as a patty thereto, such amendment to be either in addition to or in substitution of the execution and delivery of the CalTrans Agreement. If such an amendment to the Belmont Agreement is entered into, it shall be in such form as the City Manager, with the advice of the City Attorney, may require or approve, such approval to be conclusively evidenced by the execution and delivery thereof. Pursuant to Section 53316.2 of the Act, the City Council hereby determines that the execution and delivery of the CalTrans Agreement, or the amendment of the Belmont Agreement to add CalTrans as a party thereto, following the adoption of this resolution and the effective date 15287.5x22931.0003 6 13~11
