ORIGINAL <br /> AMENDMENT NO. 3 TO AGREEMENT FOR ENVIRONMENTAL SERVICES FOR <br /> PENINSULA PARK <br /> (Wagstaff&Associates) <br /> This Amendment No. 3 is entered into and effective as of the isti day of <br /> „ FO, , 2007, amending the agreement dated October 11, 2006 (the <br /> "Agreement") by and between the City of Redwood City, a charter city and municipal <br /> corporation ("City"), and Wagstaff & Associates, ("Consultant") (collectively, the <br /> "Parties") for Peninsula Park. <br /> RECITALS <br /> A. On May 9, 2007 the Parties executed Amendment No. 1 to the <br /> Agreement to revise the analysis to reflect the changes that occurred to current traffic <br /> conditions and changes to the project description; and <br /> B. On November 16, 2007 the Parties executed Amendment No. 2 to the <br /> Agreement to authorize additional funds in order to accommodate some additional <br /> scope work to complete the Peninsula Park EIR Addendum; more specifically, the <br /> additional traffic analysis prepared by Fehr and Peers, revised text . regarding <br /> wastewater, and general preparation of the final document; and <br /> C. The Parties desire to alter the Agreement's scope of work for additional <br /> compensation for City-requested added tasks towards completion of the Peninsula Park <br /> EIR Addendum; and <br /> D. The Parties have negotiated and agreed to a supplemental scope of work <br /> and fee schedule, which is attached to and incorporated by this reference as Exhibit <br /> "A," Scope of Services and Fee. <br /> NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br /> contained herein, the Parties agree as follows: <br /> 1. In addition to those services contained in the Agreement, as may have <br /> been amended from time to time, Consultant will provide those services described in <br /> Exhibit "A" entitled, "Requested Budget Amendment For Peninsula Park EIR <br /> Addendum" dated November 8, 2007. With this Amendment, the total aggregate <br /> agreement amount shall total One Hundred Thirty Seven Thousand Three Hundred <br /> Fifty Eight Dollars and Ninety Cents ($137,358.90). <br /> 2. City will pay Consultant for all work associated with those services <br /> described in Exhibit "A" on a time and materials basis not-to-exceed Thirty Seven <br /> Thousand and Three Dollars and Ninety Cents ($37,003.90). Consultant will provide <br /> City, on a monthly basis, copies of invoices sufficiently detailed to include hours <br /> performed, hourly rates, and related activities and costs for approval by City. <br /> 3.
