This insurance shall include, 13ut not be limited to, <br /> premises and operations; contractual liability covering the indemnity provisions contained <br /> in this Agreement; personal injury; explosion, collapse, and underground coverage, <br /> products and completed operations, and broad form property damage. <br /> <br /> (c) Prior to commencing work or entenng onto the Property, Level 3 shall file a <br /> Certificate(s) of Insurance or declaration page(s), as requested by the Director, with the <br /> City Clerk evidencing coverage. Said Certificate(s) and declaration pages shall stipulate: <br /> The insurance company(ies) issuing such policy(ies) shall give wdtten notice <br /> to the City Manager of any matedal alteration, or reduction in aggregate limits, <br /> if such limits apply, and provide at least thirty (30) days notice of cancellation. <br /> <br /> > That the policy(ies) is(are) Primary Insurance and the insurance company(ies) <br /> providing such policy(ies) shall be liable thereunder for the full amount of any <br /> loss or claim which Level 3 is liable for under this Section, up to and including <br /> the total limit of liability, without right of contribution from any other insurance <br /> effected or which may be effected by the City. <br /> <br /> > The policy(ies) shall also stipulate: Inclusion of the City, its Council, <br /> commission, boards, committees, officers, employees, and agents as an <br /> additional insured shall not in any way affect its dghts either as respects any <br /> claim, demand, suit, or judgment made, brought or recovered against Level 3. <br /> Said policy(les) shall protect Level 3 3nd the City in the same manner as <br /> though a separate policy had been issued to each, but nothing in said <br /> policy(ies) shall operate to increase the insurance company's liability as set <br /> forth in its policy(ies) beyond the amount or amounts shown or to which the <br /> insurance company would have been liable if only one interest had been <br /> named as an insured. <br /> <br />F:Atty/Agr.076 19 <br />100702 <br /> <br /> <br />
