(c) any and all renewals, replacements, extensions, amendments or
<br />modifications hereof or of the Note or this Deed of Trust.
<br />
<br /> The foregoing items set forth in subsections (a)-(c) of this Section 1 of this Deed of
<br />Trust are hereinafter collectively referred to as the "Obligations."
<br />
<br />Maintenance~ Repair and Restoration of Improvements, Payment of Liens~ Etc.
<br />
<br /> 2. Tmstor shall: (i) promptly repair, restore or rebuild any buildings now or
<br />hereafter constructed on the Land which may become damaged or be destroyed, (ii)keep the
<br />Mortgaged Property in good condition and repair, without waste, and free from mechanics' liens
<br />and all other liens and claims for lien, encumbrances, conditions, restrictions, easements and
<br />other similar matters of any kind or nature whatsoever, (iii)pay when due any indebtedness
<br />which may be secured by a mortgage or security agreement on any portion of the Mortgaged
<br />Property, whether senior or junior to this Deed of Trust and whether pe.nitted by the terms
<br />hereof or otherwise, and comply with all requirements of all Note documents evidencing or
<br />securing such indebtedness, (iv) comply with all laws, ordinances, roles, regulations, orders and
<br />restrictions of record with respect to the Mortgaged Property and the use thereof, (v) make no
<br />material alterations in or to the Mortgaged Property, except as required by law or municipal
<br />ordinance, without Beneficiary's prior written consent, (vi) pay each item of indebtedness
<br />secured by this Deed of Trust when due according to the terms thereof, and pay, perform, satisfy
<br />and discharge each of the Obligations when required to do so under the temps of the Note and
<br />this Deed of Trust.
<br />
<br />Payment of Impositions
<br />
<br /> 3. Tmstor shall pay any and all installments of the Impositions (as hereinafter
<br />defined) before the same become delinquent and shall, upon request, furnish Beneficiary
<br />duplicate receipts therefor; provided, however, that Tmstor may pay such Impositions under
<br />protest and thereafter seek a refund of such Impositions or any portion thereof in accordance
<br />with applicable law. If Trustor fails to pay such amounts, Trustor shall forward to Beneficiary,
<br />any and all delinquency notices, and Beneficiary may, at its sole option, but without obligation,
<br />pay them, together with all costs, interest and penalties thereon, which amounts shall be
<br />additional Obligations secured hereby immediately due and payable bearing interest at the rate
<br />set forth in the Note until paid. As used herein, "Impositions" shall mean all taxes, assessments,
<br />water and sewer rents and charges, transit taxes, county taxes, permit fees and other
<br />governmental or nongovernmental charges, general and special, ordinary and extraordinary,
<br />unforeseen and foreseen, of every kind and nature whatsoever which, at any time prior to or
<br />during the term of this Deed of Trust, may be assessed, levied, confirmed or imposed upon the
<br />Trustor or the Mortgaged Property or become due and payable out of or in respect to, or become
<br />a lien upon the Mortgaged Property.
<br />
<br />Insurance
<br />
<br /> 4. Trustor shall maintain policies of insurance on the Mortgaged Property as
<br />required by the Lease. Beneficiary shall be named as an additional insured on such policies.
<br />Such policies shall not be cancelable or subject to modification except after thirty (30) days'
