THIS FIIZST AMENDMENT TO LEASEHOLD DEED OF TRUST, ASSIGNMENT OF <br /> RENTS, SECURITY AGREEMENT AND FIXTURE FILING (the "Amendment") is dated as <br /> of September l, 2013, by and among SHORES CffiLDCARE, LLC, a California limited <br /> liability company ("Trustor") organized and existing under the laws of the State of California, <br /> whose address is 3970 Woodside Road, Woodside, California 94062, FIRST AMERICAN <br /> TITLE INSURANCE COMPANY ("Trustee") whose address is 2755 Campus Drive, Suite <br /> 125, San Mateo, California 94403, and CITY OF REDWOOD CITY, a charter city and <br /> municipal corporation ("Beneficiary") whose address is 1017 Middlefield Road, Redwood City, <br /> California 94063. <br /> RECITALS <br /> A. The Beneficiary is the present mortgagee under that certain Leasehold Deed of <br /> Trust, Assignment of Rents, Security Agreement and Fixture Filing given by Trustor to Trustee <br /> for the benefit of Beneficiary, dated as of January 1, 2003 and recorded as Document No. 2003- <br /> 035252 in the office of the Recorder of San Mateo County (the "Security InstrumenY'), <br /> encumbering Trustor's interest in that certain parcel of real property situated in the City of <br /> Redwood City, County of San Mateo, State of California, more particularly described in Exhibit <br /> "A"and attached hereto. <br /> B. The parties hereto wish to amend the Security Instrument to reflect the execution <br /> and recordation of a First Amendment To Note Secured By Deed Of Trust ("Amended Note") <br /> dated as of September 1, 2013. <br /> NOW, THEREFORE, for good and valuable consideration, the receipt of which is hereby <br /> acknowledged,the parties hereto agree as follows: <br /> 1. Amendment to Securitv Instrument <br /> (a). Reference to "Note" in the Security Instrument. Any reference to "Note" <br /> in the Security Instrument shall be replaced by reference to "Amended Note" as defined above in <br /> the Recitals section. <br /> 2. Full Force and Effect. Except as modified by this Amendment, the Security <br /> Instrument shall remain in full force and effect. <br /> 3. Governing Law.
