By motion, authorize the Executive Director to execute Amendment No. 3 to
agreement for professional services with Freedman, Tung & Bottomley (FTB) for
services related to the construction of Courthouse Square, extending the
expiration date to February 28, 2007 and approving additional services in an
amount not-ta-exceed $52,000.

2. By motion, approve the appropriation of funds from the Redevelopment Agency
2008/07 Capital Budget "Contingency" fund, Account No. 803-76000 to pay for
the additional services.

Background
The original agreement with FTB for conceptual design services for Courthouse Square
was entered into in April, 2003 for $195,910. The first amendment, dated February,
2005 for $15,658, was for the development of design alternatives recommended by the
City Council, Planning Commission, and Architectural Review Committee related to the
pavilions and a possible interactive fountain, and an additional joint study session. The
second amendment in April, 2005 for $783,047 was for construction drawings for the
Square and construction phase services.

The current agreement (Amendment No.2) expired on September 30,2006. This was
the original date of planned construction completion for the Courthouse Square project.
The construction schedule has been extended by approximately three months and as a
result the budget for construction support forecasted by the design team of FTB will be
exhausted soon. Based on the remaining items scheduled for completion, staff
recommends extending the agreement for professional consulting services through
February 28, 2007 to account for full acceptance of all remaining construction work.
The budget for construction support should also be increased by an additional $52,000
to account for the additional time and services anticipated to insure satisfactory
completion of all design details.

REDEVSHARED_2006 STAFF REPORTS_11-2006]TB Amend 3
