6.1E Page 3 AMENDMENT NO.3 TO EXTEND AND AMEND AGREEMENT FOR PROFESSIONAL CONSULTING SERVICES (FREEDMAN TUNG & BOTTOMLEY) This Amendment No.3 is entered into and effective as of the _ day of , 2006, extending and amending the agreement dated April 28, 2003 (the "Agreement") by and between the Redwood City Redevelopment Agency, a public body, corporate and politic, duly organized and existing under the laws of the State of California ("Agency"), and FREEDMAN TUNG & BOTTOMLEY, ("Consultant") (collectively, the "Parties") for PROFESSIONAL CONSULTING SERVICES FOR PREPARING CONCEPTUAL DESIGN IN FRONT ON THE HISTORIC COURTHOUSE PLAZA. RECITALS A. On February 15, 2005 the Parties executed Amendment No. 1 to the Agreement for the preparation of additional design alternatives for the Plaza and a joint study session presentation. 8. On April 27, 2005 the Parties executed Amendment No. 2 to the Agreement for design development, construction documents, and construction phase services. C. The Parties desire to alter the Agreement to extend and fund the Agreement. NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, the Parties agree as follows: 1. That the Agreement, as may have been amended from time to time, is hereby extended for a period of 5 (five) months ending on February 28, 2007 and Consultant will be paid a not to exceed amount of Fifty two thousand dollars ($52,000.00) to continue to provide construction support services, which are referenced in Exhibit "A" of Amendment No.2, to insure satisfactory completion of all design details on Courthouse Square. 2. All other provisions of the Agreement, as may have been amended from time to time, will remain in full force and effect. 3. All requisite insurance policies to be maintained by the Consultant pursuant to the Agreement, as may have been amended from time to time, will include coverage for this Amendment. 4.
