<br />6.1E <br />Page 1 <br /> <br />REPORT <br /> <br /> <br />December 4, 2006 <br /> <br />Subject <br />Approval of Settlement and Release Agreement with Sonic Automotive (the parent <br />company of Autobahn Motors) - Ralston/101lnterchange Reconfiguration Project <br /> <br />Recommendation <br />Approve and authorize execution of Settlement and Release Agreement in the amount <br />of $85,795 with Sonic Automotive of Charlotte, North Carolina. <br /> <br />Background <br />As part of the Ralston/101 Interchange Reconfiguration Project, the Island Parkway <br />overpass was built to connect Island Parkway directly to Marine Parkway. Because of <br />this new alignment of Island Parkway, some right of way had to be acquired from this <br />property owner. The footprint of the new overpass basically clips a corner of this <br />property where a retaining wall separated the pre-existing parking lot from the old <br />Island Parkway. <br /> <br />This retaining wall had to make way for the new overpass and was therefore removed. <br />Because of oversight, the rebuilding of this retaining wall was not included in the <br />original design of the Interchange project. However, it is clear that the rebuilding of this <br />wall should be part of the site restoration of this property. This rebuilding could have <br />occurred last year and the project's general contractor could have completed this. <br />However, the property owner was in negotiation with the City of Belmont for the lease of <br />the space under the overpass at that time, and could not settle on where the wall <br />should be built. This was compounded by the fact that winter conditions arrived by the <br />time the decision was made and the wall has not been designed while the project <br />general contractor was already demobilizing. Given those factors, the property owner <br />went ahead and had the wall designed as part of the improvements that they are <br />making for the area under the overpass. <br /> <br />The property owner recently received the necessary building permit from the City of <br />Belmont for the wall along with other improvements to his facility and is ready to <br />proceed with construction. Staff obtained a copy of the improvement plans and has <br />verified, through an independent bid from another contractor, that the construction cost <br />for the wall claimed by the property owner is reasonable. By settling with the property <br />owner, the City will not be liable for the design, construction, and administration of the <br />rebuilding of this wall. <br /> <br />Page 1 of2 <br />
