<br />CES:djm02/27/90 (014/42) <br /> <br />EXHIBIT "A" <br /> <br />AMENDMENT TO AGREEMENT <br />IMPROVEMENTS FOR PROMONTORY POINT <br />AT SHOREBIRD ISLAND SUBDIVISION <br /> <br />THIS AMENDMENT TO AGREEMENT made this day of <br />, 1990 by and between the CITY OR REDWOOD CITY, <br />a municipal corporation of the State of California, ("City") and <br />MEGA CONSTRUCTION AND DEVELOPMENT, San Mateo, California, <br /> <br />("Owner") ; <br /> <br />WIT N E SSE T H : <br /> <br /> <br />WHEREAS, City and Owner entered into that certain agreement <br /> <br />enti tIed "Agreement for Improvements For Promontory Point at <br /> <br /> <br />Shorebird Island Subdivision", approved pursuant to resolution <br /> <br /> <br />No. 11212 adopted January 22, 1990 by City's City Council (the <br /> <br /> <br />"Basic Agreement"); and <br /> <br /> <br />WHEREAS, the Owner has experienced uncertainty relating to <br /> <br />the development of Promontory Point at Shorebird Island <br /> <br />Subdivision due to environmental concerns at Westport; and <br /> <br />WHEREAS, City and OWner desire to amend the Basic Agreement <br /> <br /> <br />to extend the completion date for the improvements, and to <br /> <br /> <br />provide a mechanism for further extensions should the need arise; <br /> <br /> <br />NOW, THEREFORE, the parties hereto agree as follows: <br /> <br /> <br />1. EXTENSION OF COMPLETION DATE. The Basic Agreement is <br /> <br /> <br />hereby amended by changing the completion date for improvements <br /> <br />from January 21, 1991 to June 21, 1992. <br /> <br />11247 <br />
