<br />6.2A <br />Page 1 <br /> <br />REPORT <br /> <br /> <br />December 11, 2006 <br /> <br />Subject <br />Final Acceptance - 585 Whipple Avenue (Chevron Gas Station) <br /> <br />Recommendation <br />By motion, accept the improvements for the Chevron Gas Station at 585 Whipple <br />Avenue, and authorize the release of the bonds, following the submission of a <br />Warranty Bond in the amount of $17,300.00, per contract obligations. <br /> <br />Background <br />On August 22,2005, the City Council approved a Construction Agreement with Oyster <br />and Oyster Investments for a new gas station, new market building, and street and <br />utility improvements for 585 Whipple Avenue. <br /> <br />Per the Construction Agreement, Oyster and Oyster Investments has constructed fire <br />line, water service lines, sewer line, storm drain lines, and sidewalk. The construction <br />work on the public right-of-way has been completed per the Agreement, the plans, <br />specifications, and to the satisfaction of the City's Engineering and Construction <br />Services. <br /> <br />Alternative <br />The only alternative is to not accept the project, which would be contrary to prior <br />Council interest. <br /> <br />Fiscal Impacts <br />The City will maintain the street and utility improvements, upon acceptance of the <br />improvements by the City.
