6.28
Page 1

REPORT

To the Honorable Mayor and City Council
From the Ci ,~ana er

December 11, 2006

Subject
Final Acceptance - Fleishman Park Renovation Project

Recommendation
By motion, accept the Fleishman Park Renovation Project, authorize final value of
contract, and authorize the release of bonds and retention per contract obligations.

Background
On May 8, 2006, the City Council approved Contract Documents, and authorized the
award of Contract for the Fleishman Park R.enovation Project to Star Construction, Inc,
This project is located at the intersection of McEvoy and locust Street.

The renovation included furnishing and installing new prefabricated restroom
structures, new playground structures and safety surfaces, construction of new
concrete walkway, new landscaping elements, new site furnishings, new plant
materials, new safety fence and shade structures. The mature trees were trimmed to
open up the park and new turf was installed, because the old turf did not survive the
construction activities.

A "soft opening" was held on October 21, 2006, prior to the installation of the new
restroom, which is a long lead time item. More than 150 community members attended
the event to receive the park into their neighborhood. This community involvement
started early in the design stage, and will continue with the participation of the
community, to install art work in the park over the coming years.

The project was awarded for the base bid of $500,000. Four Change Orders, totaling
$58,635 (11.7%), were issued to account for various unforeseen conditions, quantity
adjustments of materials, and design adjustments needed to complete the project.

Each change was scrutinized to ensure the quality of the project, and staff tried very
hard to keep the project within the contract amount; however, the amount of changes
still exceeded staffs threshold of 10%. The final value of the contract is $558,635.00.

Alternative
Do not accept the project, which would be contrary to previous Council action.

Page 1 of2
