<br />DES:djk 03/0l/89 (034/24) <br /> <br />ORIGINAL <br /> <br />RES 0 L UTI 0 N <br /> <br />--------- <br /> <br />N Q. ..:'. u ~1 9-Z <br /> <br />MAR - 6 1989 <br /> <br />RESOLUTION SUMMARILY VACATING A PUBLIC SERVICE EASEMENT <br />AND APPROVING AND AUTHORIZING ACCEPTANCE OF DEED OF <br />EASEMENT IN EXCHANGE THEREFOR <br /> <br />(LAKESHORE TOWNHOMES UNIT NO. 1 SUBDIVISION) <br /> <br />WHEREAS, pursuant to the provisions of Chapter 4 (commencing <br /> <br />with S8330), Part 3, Division 9 of the Streets and Highways Code <br /> <br />of the State of California, this Council may summarily vacate a <br /> <br />public service easement, if such easement has been superseded by <br /> <br />relocation and there are no other public facilities located <br /> <br />within said easement; and <br /> <br />WHEREAS, a portion of a public service easement as shown on <br /> <br />that certain map entitled "Lakeshore Townhomes unit No. 1 - City <br /> <br />of Redwood City, County of San Mateo, State of California" filed <br /> <br />August 3, 1988, in Book l18 of Maps at pages 65-77 inclusive, <br /> <br />Official Records of San Mateo County, shall no longer be required <br /> <br />for public uses provided that said portion be relocated; and <br /> <br />WHEREAS, the owner of record of the property affected <br /> <br />thereby proposes to convey to the City a deed of easement in <br /> <br />exchange for the portion to be vacated; and <br /> <br />WHEREAS, the value of the property interest to be received <br /> <br />by the City pursuant to said exchange equals or exceeds the value <br /> <br />of the property interest to be vacated; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />l.
