(d) Before construction of any Improvements are commenced on the <br />Leased Premises and before any building materials therefor have been delivered to the <br />Leased Premises by Lessee or agents under Lessee's authority, Lessee shall comply with <br />the following conditions or procure Lessor's written waiver of the condition or conditions <br />specified in the waiver: <br />(1) Visual and Environmental Impact. Lessee shall use its best <br />efforts to make any Improvements on the Leased Premises aesthetically pleasing and <br />environmentally neutral. Notwithstanding the foregoing, Lessor reserves the right to <br />require that reasonable measures be undertaken to improve the visual or environmental <br />impact of any proposed improvement or alterations of the Leased Premises. <br />(2) Construction Schedule. Lessee shall deliver to the Lessor <br />for the Lessor's approval a time schedule setting forth in detail a description of the <br />Improvements and all steps for construction of the Improvements, and Lessee's best <br />estimate of the date upon which each step shall be substantially completed. The Lessor's <br />approval, which shall not be unreasonably withheld, or disapproval of the schedule shall <br />be communicated to Lessee in the manner provided for the giving of notice herein and <br />any disapproval shall be accompanied by a specification of the grounds for disapproval. <br />(3) Protection of Adiacent Property, Indemnity of the Lessor. <br />Lessee shall protect Lessor's property against damage resulting from the performance of <br />any work undertaken by Lessee or Lessee's agents, employees, contractors, or assigns, <br />and shall indemnify the Lessor against all liens or liability in any way arising out of the <br />performance of the work or the furnishing of labor, services, materials, supplies, <br />equipment or power in connection therewith. <br />LeaseAgreement-CommunicationsSite-02/02/06 SITE #599A 11 <br />
