Lessee's Facilities from the Leased Premises to any other portion of the Emerald Lake <br />Hills Water Tank Property (the "Alternate Leased Premises"), subject to the terms set <br />forth below; provided, however, that the reason for the relocation is that Lessor has <br />decided to proceed with its water tank replacement project replacing the two wood water <br />tanks currently located on the Emerald Lake Hills Water Tank Property. <br />(b) The size, location and dimensions of the Alternate Leased Premises shall <br />be chosen by Lessor but must, in Lessee's reasonable judgment, be at least as suitable for <br />purposes of operating a communications facility as the size, location and dimensions of <br />the Leased Premises. If the Alternate Leased Premises are not suitable for Lessee's <br />operations, as determined by Lessee in its reasonable judgment, then Lessor shall not <br />require Lessee to relocate to such Alternate Leased Premises and Lessee shall remain on <br />the Leased Premises until the expiration or earlier termination of this Lease. <br />(c) Lessee shall not be required to relocate the Lessee Facilities to any <br />location which would result in any deterioration or diminution of the quality of <br />communication services or other services provided by Lessee from the Leased Premises, <br />nor shall Lessee be required to conduct such relocation in a manner which would cause <br />any deterioration or diminution of such quality or which would cause any interruption of <br />such services. <br />(d) The relocation of the Lessee's Facilities to the Alternate Leased Premises <br />shall not cause the Rent payable under the Lease to be increased. <br />(e) The relocation of the Lessee's Facilities to the Alternate Leased Premises <br />shall be accomplished by Lessee at Lessee's sole cost and expense. <br />LeaseAgreement-CommunicationsSite-02/02/06 SITE #599A 24 <br />
