County Recorder. A lien created pursuant to this Article shall be <br />prior to all other liens recorded subsequent to the recordation of <br />the Notice of Delinquent Assessment. <br /> <br />No ~ction snail be brought to for~c!ose t lien securing an unpaid <br />assessment until the Notice of Delinqumnt Assessment has b~en <br />delivered to the Owner of the Lot subject to such assessment and <br />notice recorded in the Office of the Sa Mateo County Recorder. <br />Said notice shall state the amount of the ~ssessment together with <br />the interest, costs and reasonable at torneys' fees~ a legal <br />description of the Lot against which the assessment has been made <br /> £ <br />and the nam~ or n~unes of the record Owne~ or Owners against which <br />the lien is imposed and, in order for th.~ lien to be enforced by <br />nonjudicial ~oreclosure as provided elsewh mre in this Article, the <br />name and address of the trustee authoriz,~d by the Association to <br />enforce the'~lien by sale. The Notice cf Delinquent Assessment <br />shall be si~ned by the person designate~ by the Association to <br />enforce th~ lien by sale, or if no on~ is designated, by the <br />president or,the Association, and mailed i~ the manner set forth in <br />Civil Code S~ction 2924b, to all record owners of the Lot no later <br />than 10 caleftdar days after recordation. <br /> <br />After the expiration of thirty (30) days f::om the date such Notice <br />of Delinquent Assessment has been reco~'ded, an action may be <br />co~m~nced in the name of the Association t() foreclose the lien, or <br />such action may be c~=i~nced by any Owner .f the Association fails <br />or refuses to act. Upon the declaration f an assessment and the <br />recording of notice thereof, the Associa ion may, at its option, <br />declare the entire balance of all sums the~ due from the Owner due <br />and payable, which total sum may then b~ included in any suit, <br />action or proceeding brought to collect ~aid sum, including all <br />costs, charges and attorneys' fees. <br /> <br />Notwithstanding anything contained in t~is Declaration to the <br />contrary, compliance must be made with Civil Code Sections 1366- <br />67, and no action may be brought to foreclose the lien created <br />hereunder, whether judicially, by power of ;ale or otherwise, until <br />the expiration of ten (10) days after a copy of said Notice of <br />Delinquent Assessment, showing the date of ::ecordation thereof, has <br />been mailed to the Owner of the Lot descri )ed in such Notice. <br /> <br />Each Owner does hereby waive, to the exte~t of any liens created <br />pursuant to the Declaration, whether s::ch liens are now in <br />existence or are created at any time in the future, the benefit of <br />any homestead or exemption laws of the State of California now in <br />effect, or in effect in the future. <br /> <br /> 23 <br /> <br /> <br />
