ARTICLE VI <br /> <br /> EASEMENTS <br /> <br />Section 1.Generally: There are hereby s~ecifically reserved for <br />the benefit of the Lots and Lot Owners~ in co~on and for each Lot <br />and Lot Owner severally, and for the Association, as their <br />respective interests apply, the easements and righ~ of way as <br />particularly identified in this A~ticle. <br /> <br />Section 2 Easements for Utilities and Mair.tenance: The rights and <br />duties of the owners of Lots within the Pro3ect with respect to <br />sanitary sewer, drainage, water, electricity, h~ating, air- <br />conditioning, gas, telephone, cable television lines~, connections <br />and/or facilities, shall be as follows: <br /> <br />(a) Whenever sanitary sewer, drainage~ water, e~ectricity, <br />heating, air-conditioning, gas, telephone,~cable television lines, <br />connections and/or facilities, are insta%led within or upon any <br />Lots owned by other than the owner ofj a Lot served by said <br />connections, the owners of any Lot ~erved by said lines, <br />connections and/or facilities shall have t~e right, and are hereby <br />granted a non-exclusive easement to thet full extent necessary <br />therefore, to enter upon the Lot to repai~, replace and generally <br />maintain said lines, connections and/or ~facilities as and when <br />necessary. <br /> <br />(b) Whenever sanitary sewer, drainage', water, electricity, <br />heating, air-coDd4tioning, gas, telephone, ~able television lines, <br />connections and/or facilities, are instal~.ed within the property <br />which connections serve more than one Lot the owner of each Lot <br />served by said connection shall be entitled to the full use and <br />enjoyment of such portions of said connecti )ns as service his Lot. <br /> <br />(c) In the event of a dispute between own~rs with respect to the <br />repair or rebuilding of said connections, or with respect to the <br />sharing of the cost thereof, then upon wri :ten request of one of <br />such owners addressed to the Association. the matter shall be <br />submitted to the Board of Directors who sh~ll decide the dispute, <br />and the decision of the Board shall be final and conclusive on the <br />parties. <br /> <br /> 27 <br /> <br /> <br />
